- Introduction To The Terms And Conditions
1.1 The following terms (the "Terms") apply to any use by a visitor (the "User") of the Cineworld Cinemas Limited Web Site (the "Web Site"), and should be read carefully before any such use.
1.2 By accessing or using the Web Site, the User accepts and agrees to be legally bound by the Terms and acknowledges that Cineworld Cinemas Limited, as the owner and operator of the Web Site, has the right to amend or vary the Terms and any of the contents of the Web Site from time to time at its sole discretion. Amendments or variations will take effect when they are posted on the Web Site and, as a result, the User should check the current version of the Terms each time he/she uses the Web Site. The Terms, as amended or varied from time to time, apply to all use of and access to the Web Site, both now and in the future.
1.3 Separate terms and conditions may apply for any purchases made through the Web Site. If so, such separate terms and conditions will be presented at the time of such purchases. - Indemnity Obligation
2.1 THE USER AGREES TO INDEMNIFY, DEFEND AND HOLD HARMLESS CINEWORLD CINEMAS LIMITED AND ITS AFFILIATES AND SUBSIDIARIES (TOGETHER THE "CINEWORLD CINEMAS"), AND THEIR OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, AND ANY OF ITS THIRD PARTY INFORMATION PROVIDERS FROM AND AGAINST ALL LOSSES, EXPENSES, DAMAGES AND COSTS, INCLUDING REASONABLE LEGAL FEES, HOWEVER ARISING RESULTING FROM ANY VIOLATION OR BREACH OF THE TERMS BY THE USER.
- General Disclaimer
3.1 Although Cineworld Cinemas has attempted to provide accurate information on the Web Site, Cineworld Cinemas assumes no responsibility for the accuracy or completeness of such information. The User releases Cineworld Cinemas, and all of their officers, directors, agents and employees, from any liability, for any claims, losses or damages arising out of or in any way connected with the User's use of the Web Site.
3.2 To the fullest extent permitted by law, Cineworld Cinemas shall not be liable to any person or entity for any direct, indirect, special, consequential or incidental damages, including (without limitation) lost profits or revenues, loss of opportunity, costs of replacement goods or services, loss or damage to data or business interruption, arising out of or related to:
(a) any access to or use of or inability to access or use the Web Site, any other hyperlinked web site or any other information or product included or described within the Web Site; or
(b) any person or entity's reliance on the information presented,
in each case whether arising in tort (including negligence), contract or otherwise even if the User has advised Cineworld Cinemas of the possibility of such damages.
3.3 All information and content provided on the Web Site is provided "as is" without representation or warranty of any kind, either expressed or implied. Without limiting the foregoing, Cineworld Cinemas does not represent or warrant that the Web Site or any of its contents are accurate, current, complete, free from technical or typographical errors, free from changes or harmful components introduced by third parties or free from periodic interruption or errors of any other type. Cineworld Cinemas may revise the information or change the products or services mentioned on the Web Site at any time without notice. Any mention of non-Cineworld Cinemas products or services is for information purposes only and constitutes neither an endorsement nor a recommendation of them. Neither Cineworld Cinemas, nor their suppliers, make any representation or gives any warranty, condition or undertaking, expressed or implied, including (without limitation) as to the satisfactory quality, fitness for a particular purpose, suitability or non-infringement of any third party right or freedom from viruses, whether or not arising from a course of dealing, usage or trade practice.
3.4 Notwithstanding any other provision in the Terms, nothing within the Terms limits or restricts any person's liability for death or personal injury resulting from its negligence or that of its employees or agents.
3.5 The Terms and the User's use of the Web Site are governed by all applicable English law, unless the User's address provided when purchasing an online ticket is in Scotland, when Scottish law applies.
3.6 For any disputes arising out of or in connection with the Terms or the User's use of the Web Site, if the User's address provided when purchasing an online ticket is in Scotland then the Scottish courts shall have non-exclusive jurisdiction, otherwise the English courts shall have non-exclusive jurisdiction.
3.7 Cineworld Cinemas makes no representation that the content or materials on the Web Site are appropriate or available for use in other jurisdictions. Access to the Web Site's content or its materials from jurisdictions where such access is illegal is prohibited. Users who choose to access the Web Site from other jurisdictions do so at their own initiative and risk and are responsible for compliance with all relevant local laws. Cineworld Cinemas is not responsible for any violations of law as a result of the User's actions. - Trade Marks And Other Such Rights
4.1 The trade marks and logos ("Marks") displayed on the Web Site are the property of Cineworld Cinemas or other third parties. The User is not permitted to use these Marks without the prior written consent of Cineworld Cinemas or the relevant third party proprietor of the Marks, and the User acknowledges that any such use may constitute an infringement of the relevant proprietor's rights.
4.2 The User acknowledges that all intellectual property rights in all materials on the Web Site remain the property of Cineworld Cinemas or the relevant third party proprietor, licensor or other content owner. Except as expressly permitted herein, no portion of the information on the Web Site may be reproduced in any form, or by any means, without prior written permission from the Mark owner. - Links To Third Party Web Sites
5.1 The Web Site contains links to third party web sites. Access to any other web site through a link on the Web Site is at the User's own risk and Cineworld Cinemas is not responsible for the accuracy or reliability of any information, data, opinions, advice or statements made on these sites or the security of any link or communication with those sites.
5.2 Cineworld Cinemas reserves the right to terminate a link to a third party site at any time.
5.3 The provision of a link to a third party web site through the Web Site does not mean that Cineworld Cinemas endorses, authorises or sponsors that web site nor does it mean that Cineworld Cinemas is affiliated with the third party web site's owners or sponsors. Cineworld Cinemas provides these links merely as a convenience for the User. - Online Ticket Purchases
6.1 The following terms apply if the User uses a credit/debit card to purchase tickets through the Web Site.
6.2 Cinema tickets are sold by Cineworld Cinemas at standard prices for the relevant performance. By requesting tickets through the Web Site, the User is placing a booking request for tickets on the Terms that is only deemed accepted by and binding on Cineworld Cinemas once it has processed valid payment and sent the User email confirmation of the User's booking.
6.3 A remote payment fee of £0.70 will be payable separately by the User to Classic Cinemas Ltd ("CCL") in relation to each cinema ticket purchased from Cineworld Cinemas, up to a maximum of £4.20 per transaction. This remote payment fee is in consideration of CCL processing remote card payments and transferring the User's payment for tickets to Cineworld Cinemas. By confirming his/her booking, the User agrees to pay this remote payment fee to CCL, in addition to the price payable to Cineworld Cinemas for tickets.
6.4 The email confirmation of a booking will set out the details of the cinema tickets purchased and the total amounts paid to Cineworld Cinemas/CCL. Once this confirmation has been sent, the ticket price and remote payment fee are non-refundable. Cineworld Cinemas are not responsible in the event that the User selects the wrong film when booking tickets via the Web Site, or if the User is excluded from viewing the film under condition 6.12.
6.5 The User can pick up his/her cinema tickets immediately at his/her selected Cineworld Cinemas cinema following confirmation of his/her booking, but no later than 10 minutes following the start of the performance.
6.6 Tickets are dispensed by one of our automatic ticket collection machines or can be collected at the Box Office of the User's chosen Cineworld Cinemas cinema.
6.7 THE USER WILL NEED TO PRESENT THE DEBIT/CREDIT CARD THAT HE/SHE USED TO MAKE A BOOKING IN ORDER TO COLLECT THE RELEVANT TICKETS.
6.8 To make any payment by credit/debit card, the User must provide the cardholder's name and email address, the card number, the card security code, the card expiry date and (where applicable) the card start date and/or issue number.
6.9 Transactions will appear on the cardholder's bank or card statement as a payment to "Classic" (referring to Classic Cinemas Limited, part of the Cineworld Group).
6.10 For all concessions/student tickets, the User must bring proof of entitlement to the Box Office as this may be required upon entry to the film or collection of tickets (where applicable).
6.11 Cineworld Cinemas will endeavour to operate its cinemas in accordance with its advertised programme. However, there will be instances when its ability to show a performance is impaired by circumstances beyond its control. In such situations, Cineworld Cinemas reserves the right to cancel a performance, vary the time it shows it or provide customers with an alternative performance. If Cineworld Cinemas does have to cancel a performance, Cineworld Cinemas and CCL shall only refund the admission price and any handling fee paid for the relevant tickets, and no other costs.
6.12 Cineworld Cinemas draws the User's attention to the conditions of the British Board of Film Classification certificate for the film being shown and is obliged to and will refuse admission to any person who, in the opinion of an authorised Cineworld Cinemas employee or representative, is under the minimum age required for admittance. Cineworld Cinemas reserve the right to request any individual to provide proof of age and to exclude any such individual from any performance if they appear too young and/or cannot prove they are at least minimum age for admittance. In order for children under the age of 12 to be admitted after 7.00pm they must be accompanied by a parent or guardian.
6.13 Use of the tickets will be subject to the terms and conditions set out in the Cineworld Cinema’s Entry Policy, which forms part of the Terms.
6.14 All transaction details, including credit card details, are encrypted using Secure Sockets Layer. Further, Cineworld Cinemas seeks to ensure that bank details are never transmitted in clear text through the Cineworld Cinemas booking system. - Web Site Security
7.1 The User agrees not to corrupt (or attempt to corrupt) any data or to circumvent (or attempt to circumvent) any of the security safeguards of Cineworld Cinemas or any of its suppliers.
7.2 The User acknowledges that the Internet is not entirely secure and whilst Cineworld Cinemas will take all reasonable steps to safeguard the security of any credit card information the User imparts through encryption methods, Cineworld Cinemas shall not be liable for any damage that the User may suffer as a result of the loss of confidentiality of any such information. - Access To MyCineworld
8.1 Access to the MyCineworld area of the Web Site is restricted to authorised Users only. Unauthorised individuals attempting to access the MyCineworld of the Web Site may be subject to prosecution.
8.2 The User is solely responsible in all respects for any use of the username and password which the User selects at the time he/she registers for the MyCineworld area. The User must not share their password with, or transfer it to, any third parties.
8.3 If the User becomes aware of any unauthorised use of their username and password, they must notify Cineworld Cinemas immediately either by emailing customer.services@cineworld.co.uk, or by telephoning 0870 777 2775. Cineworld Cinemas will not be responsible for any such unauthorised use. - Privacy
9.1 The User acknowledges that Cineworld Cinemas is entitled to handle any personal information that the User supplies when using the Web Site in accordance with the Privacy Policy, which forms part of the Terms.
- Miscellaneous
10.1 The failure of Cineworld Cinemas to insist upon or enforce strict performance of any provision of the Terms shall not be construed as a waiver of any provision or right.
10.2 Cineworld Cinemas may assign, transfer or, where permitted by law, declare a trust over the benefit of its rights and obligations under the Terms to any party at any time without notice to the User. The User may not assign, transfer or declare a trust over his/her rights or obligations under the Terms without Cineworld Cinemas' prior written consent, which may be withheld at its absolute discretion.
10.3 Cineworld Cinemas will not be in breach of the Terms or otherwise liable for any delay in performance of them to the extent that such breach or delay is due to circumstances beyond its reasonable control.
10.4 If any part of the Terms is unenforceable, invalid or illegal (including any provision in which Cineworld Cinemas excludes its liability to the User), the enforceability, validity or legality of any other part of the Terms will not be affected or impaired in any way.
10.5 The Terms embody and set forth the entire agreement and understanding between Cineworld Cinemas and the User and supersede all prior oral representations (including negligent representations) or written agreements, understandings or arrangements with respect to the subject matter hereof. Neither party shall be entitled to rely on any agreement, understanding or arrangement which is not expressly set forth in the Terms. The provisions of this clause shall not exclude any liability or any right which either party may have in respect of any statements made fraudulently prior to User's acceptance of the Terms or any fraudulent concealment by the other.
10.6 Any notice to be given by either party to the other may be sent by email, fax or recorded delivery to the address of the other. In the case of Cineworld Cinemas, this address shall be Cineworld Cinemas, Power Road Studios, Power Road, Chiswick, London W4 5PY, as amended herein from time to time. In the case of the User, such an address shall be that provided at the time of registration or such other address as the User may from time to time have communicated to Cineworld Cinemas in writing or by email to customer.services@cineworld.co.uk. If sent by email, a notice shall be deemed to be received on the day it was sent or, if sent by fax, shall be deemed to be served on receipt of an error free transmission report or, if sent by recorded delivery, shall be deemed to be served two days following the date of posting.
10.7 Some of the provisions of the Terms are for the benefit of Cineworld Cinemas and its officers, directors, employees, agents, subsidiaries, affiliates, suppliers and third party information providers. Each of these persons or entities shall have the right to assert and enforce those provisions directly against the User on its own behalf if the User violates any of the Terms. Save for the foregoing, the Contracts (Rights of Third Parties) Act 1999 shall not apply to the Terms and no rights or benefits expressly or impliedly conferred by them shall be enforceable under that Act against the parties by any other person.
10.8 The Web Site is provided by Cineworld Cinemas Limited, a company registered in England and Wales (company number: 01915767), whose registered office is at 7th Floor, 90 High Holborn, London WC1V 6XX with VAT number 606 197 048. Classic Cinemas Limited which is referred to in clause 6.3 has the company number: 03106984, and has its registered office at 7th Floor, 90 High Holborn, London, WC1V 6XX. Cineworld Cinemas and Classic Cinemas Limited can be contacted at Power Road Studios, Power Road, Chiswick, London W4 5PY, by emailing customer.services@cineworld.co.uk or by telephoning 0844 815 7747. All prices displayed on the Web Site are (unless otherwise stated) inclusive of VAT (where applicable).
Cineworld Cinema’s Entry Policy
- Introduction
1.1 Cineworld wants all of its customers to enjoy their visit to its cinemas. To help ensure this, admission to any Cineworld cinema is subject to the following terms and conditions. By purchasing or using a Cineworld cinema ticket, customers (including "Unlimited" card holders) agree to be bound by these terms and conditions.
- Key Points
2.1 Behaviour: Disruptive, antisocial or violent behaviour by a customer or group of customers directed toward other customers or staff members will result in the offending customer or group of customers being required to leave the cinema immediately without any entitlement to a refund. What constitutes disruptive, antisocial or violent behaviour shall be determined at the sole discretion of the Cineworld Duty Manager and includes both physical and verbal abuse.
2.2 Alcohol and Food Policy: No alcohol, food or soft drink may be brought onto the premises. Only food and drink bought on the premises may be consumed on the premises. Alcohol may only be purchased and consumed in Cineworld licensed bar areas or in licensed screens and licensing laws will be strictly enforced.
2.3 Mobile Devices: All mobile devices including mobile telephones must be switched off at all times during the feature presentation.
2.4 Piracy: Customers are not allowed to bring any form of recording or copying equipment (in whatever medium) into the auditorium. Recording or copying equipment taken into the auditorium may be confiscated for inspection by the Cineworld Duty Manager. Customers are reminded that it is a serious criminal offence to copy or attempt to copy any film, soundtrack or other copyright protected material shown in the auditorium and customers found in contravention will be liable on conviction to an unlimited fine and imprisonment of up to 10 years.
2.5 Certification: Cineworld is not responsible for the certification of adverts, trailers or films. All complaints in respect of the wrongful classification of any of these items should be directed to the British Board of Film Classification (the BBFC).
2.6 Search Policy: Cineworld reserves the right to search a customer's possessions whilst on the premises for any item which a staff member believes may contravene these terms and conditions. Customers must consent to being searched for any item which a staff member believes may contravene these terms and conditions. Failure to give consent will result in the Cinema Duty Manager refusing entry or requiring the customer to leave the premises immediately without any entitlement to a refund.
2.7 Parking: Cineworld is not responsible for the parking regulations imposed by third parties, including any cost imposed on customers. Customers should take up any issues directly with the third party concerned. - Entry Into The Cinema
3.1 Only customers in possession of a valid ticket will be admitted into the auditorium to which the ticket relates and admission will be permitted only for the duration of the performance specified by the ticket. At the time of collection, customers should check that the ticket's details are correct as tickets cannot be later exchanged or refunded in the event of any error.
3.2 Lost, stolen or damaged tickets will not be replaced. Any customer who does not hold a valid ticket may be required to leave the premises.
3.3 Customers should keep the ticket stubs with them at all times in order to re-enter the relevant auditorium.
3.4 Cineworld will refuse admission to any person who, in the opinion of an authorised Cineworld employee or representative, is under the minimum age required by the BBFC classification for a presentation and cannot prove that they are at least the minimum age required. Cineworld expressly reserves the right to request photographic identification verifying the age of the customer (e.g. a driving licence or passport) for entry into 12A, 15 and 18 certificated films. Photocopies of birth certificates, passports and driver’s licences are acceptable. Children under the age of 12 must be accompanied by someone who is at least 18 years of age to be admitted after 7.00pm. Children under the age of 8 must be accompanied by someone who is at least 18 years of age at all times (regardless of film classification).
3.5 Student tickets will only be issued upon the production of valid National Union of Students photographic identification showing a clear photograph of the student and the applicable expiry date of the identification. Student tickets will be limited to one per student. Photographic identification may be checked before admission to the auditorium in the case of pre-booked tickets.
3.6 Customers aged 15, 16 or 17 are entitled to student tickets without presenting student identification, however they may be required to provide identification in order to verify their age.
3.7 Customers entitled to a free carer’s ticket must provide a valid Cinema Exhibitors' Association Card (CEA card) or locally issued disability card. Please see www.ceacard.co.uk for the full terms of use. Guide and Hearing dogs are welcome but other animals are not permitted on the premises.
3.8 In order to avoid disturbing other customers, customers who arrive after the start of the feature presentation will only be permitted entry into the auditorium at the Cinema Duty Manager's sole discretion. - Our Obligations
4.1 Although Cineworld seeks to follow its advertised programme, it reserves the right to cancel or reschedule a performance or to substitute an alternative film or presentation, if forced to do so by circumstances beyond its control.
4.2 If a film showing or other presentation is cancelled, rescheduled or substituted, the Cinema Duty Manager will have the sole discretion to decide whether to refund customers the cost of their tickets or to issue replacement tickets for the same film or presentation at an alternative time. - Safety And Security
5.1 Cineworld reserves the right to refuse the entry onto its premises of any person who is believed to be intoxicated and may require any person or customer who is believed to be intoxicated to leave the premises immediately without any entitlement to a refund.
5.2 No customer is allowed to bring any illegal substances or weapons onto the premises. Anyone found in possession of such items will be refused entry or will be required to leave the premises immediately without any entitlement to a refund. Cineworld takes such matters seriously and may report the incident to the police.
5.3 In order to comply with applicable health and safety legislation, customers must at all times remain within the public areas of the premises and must not obstruct the aisles with personal belongings.
5.4 Customers must keep their personal belongings with them at all times. Cineworld accepts no responsibility for the loss, theft, alteration or damage to any personal items brought onto the premises.
5.5 Customers are not permitted to smoke on the premises of any Cineworld cinema. Any person or customer found to be in contravention of this rule will be required to leave the premises immediately without any entitlement to a refund. - Other Matters
6.1 Nothing in these terms and conditions affects your statutory rights as a customer or excludes or limits Cineworld's liability for fraud or for death or personal injury resulting from Cineworld's negligence or for any other liability which Cineworld cannot exclude or limit under law but otherwise Cineworld's liability to you as a customer shall be limited to the ticket price paid.
6.2 In addition to its other rights, in the event that a customer or group of customers breach or breaches any of the terms and conditions of this policy, Cineworld reserves the right to take such action as is necessary to prevent a reoccurrence of such breach (including recovering any costs incurred). Such action may include banning the relevant customer or customers from all Cineworld premises and/or taking legal action.
6.3 Cineworld reserves the right to charge for any additional service or product which it may supply including but not limited to 3D glasses.
6.4 Any Cineworld Duty Manager may refuse entry to any person onto the premises of the relevant Cineworld cinema at any time and will be under no obligation to provide a reason to that person.
6.5 Cineworld accepts no responsibility for any information displayed or broadcast on the premises by any third party.
6.6 Cineworld reserves the right to amend these terms and conditions from time to time without notice.
6.7 “Cineworld” means Cineworld Cinemas Limited, trading as Cineworld Cinemas, Power Road Studios, Power Road, Chiswick, London, W4 5PY. Registered in England (No. 01915767). Gift Card Conditions
- Definitions
In these Card Conditions, the following words have the meanings set out against them:
Conditions: these Card Conditions and Cineworld's General Terms and Conditions;
Cineworld's General Terms and Conditions: the general terms and conditions of Cineworld for customers' attendance at Cineworld's cinemas, as may be displayed at Cineworld cinemas or on its website under the heading Cineworld Cinemas Entry Policy;
Customer Services Department: 0870 777 2775 (or +44 870 777 2775 if calling from Ireland); The Customer Services Department of Cineworld: Cineworld Customer Services, Power Road Studios, Power Road, Chiswick, London, W4 5RP, customer.services@cineworld.co.uk;
Gift Card: subject to the Conditions, a paper voucher which can be used to purchase cinema tickets, merchandise and/or refreshments in selected Cineworld Cinemas in the United Kingdom, The Channel Islands and Ireland during the Validity Period;
"Transaction Value": the value of any cinema tickets, merchandise and/or refreshments purchased with the Gift Card;
we/us/our: (i) Cineworld Cinemas Limited if you are a UK resident or (ii) Adelphi Carlton Limited (trading as Cineworld Cinemas) if you are resident in Ireland;
you/your/yours: the person to whom the Gift Card is issued.
- General
2.1 The Conditions apply to all Gift Cards and by purchasing the Gift Card you agree to be legally bound by the Conditions.
- Terms Of Use Of Cineworld Gift Card
3.1 The Gift Card is valid for use in Cineworld Cinemas or at The Screening Rooms in Cheltenham (which is operated by Cineworld Cinemas Limited), and only for the purchase of cinema tickets, refreshments and merchandise sold in Cineworld Cinemas or at The Screening Rooms.
3.2 You may give the Gift Card to anyone else to use. Please make sure that you and/or they keep the Gift Card safe as anyone who presents the Gift Card ("the User") will be able to redeem it. Where the Gift Card is less than the total Transaction Value, the User will be required to make up the difference in price.
3.3 Gift Cards may not be exchanged for cash.
3.4 Defaced, illegible, or photocopied Gift Cards will not be accepted.
3.5 Gift Cards cannot be redeemed against cinema tickets brought via the Cineworld web site at www.cineworld.co.uk (or www.cineworld.ie) or phone booking service on 0871 200 2000 (only 10 pence per minute from a BT landline, mobile and other providers may vary).
3.6 The Gift Card does not entitle the User to preferential treatment over other Cineworld customers for the purchase of cinema tickets, merchandise or refreshments, access to cinemas or otherwise.
3.7 The Gift Card does not entitle you to any credit or other form of financial accommodation.
3.8 Other taxes or costs may exist in relation to the Gift Card that are not imposed by us.
3.9 The number, location and availability of Cineworld cinemas in any area are subject to change. A list of current Cineworld cinemas is available from www.cineworld.co.uk or on written request to the Customer Services Department enclosing a stamped self-addressed envelope.
- Validity Period
4.1 The Gift Card shall be valid for 24 months Gift Cards from the date of purchase (the "Validity Period").
4.2 You may cancel the Gift Card during the "Cancellation Period". This is the period during which you may cancel the Gift Card, commencing on the date of purchase and ending the earlier of:
(a) fourteen calendar days from (and including) the day after the purchase date; and
(b) the date on which you use the Gift Card.
4.3 If you wish to cancel, please write to the Customer Services Department, enclosing the Gift Card. Once the Cancellation Period has expired you will not be able to return the Gift Card or claim a refund of the value of the Gift Card.
- Defective Cards
5.1 If the Gift Card is defective, you must return it to the Customer Services Department as soon as possible for a free replacement. Our liability in such cases is limited to replacement of the defective Gift Card.
- Questions And Complaints
6.1 Any questions or complaints you may have in relation to the Gift Card should be directed to the Customer Services Department.
6.2 No other out of court complaint or redress system or compensation scheme exists in relation to the Gift Card.
- Liability
7.1 Except as expressly provided in the Conditions, all warranties, conditions or other terms in favour of you or the User implied by Statute or common law are excluded to the fullest extent permitted by law.
7.2 Nothing in the Conditions is intended nor shall it be construed to limit our liability for fraud or death or for personal injury caused by our negligence.
7.3 We shall in no circumstances be liable if one or several Cineworld cinemas are closed permanently or temporarily, for whatever reason or if a particular film is not available for whatever reason.
7.4 We shall not be liable to you by reason of any failure or delay in performing any of our obligations in relation to the Gift Card under the Conditions if the failure or delay was due to any cause beyond our reasonable control.
7.5 We shall not be liable to you or the User in respect of any indirect or consequential loss, damage, costs or expenses or other claims for consequential compensation whatsoever which arise out of or in connection with the Gift Card.
7.6 Our liability to you or the User shall not exceed the amount paid by you for the Gift Card.
- Information Provided
8.1 You must ensure that the information you provide ("Personal Information") is accurate and complete.
8.2 You have the right to ask for a copy of any information we hold about you (for which we will charge a small fee) and to correct any inaccuracies.
8.3 The following applies to any information provided to us by you:
(a) By opting into being contacted by us when providing us with your information, you authorise us to use any information about you provided to the extent reasonably necessary to aggregate subscriber profiles and to provide you with information about offers, products and/or services offered by us from time to time. If you agree to being contacted by us when you purchase the Gift Card, you may subsequently choose to opt-out of being contacted by us by notifying the Customer Services Department between 9.00am to 5.30pm, Monday to Friday.
(b) You authorise us to transfer or disclose Personal Information provided by you to our professional advisors and such other parties as we consider necessary in the administration of our business (including financial decisions), customer profile research or if required to disclose such information by law;
(c) If you provide us with any Personal Information which relates to your racial or ethnic origin, political opinions, religion or other beliefs of a similar nature, trade union membership, physical or mental health or condition, sex life or any criminal convictions or proceedings ("Sensitive Data"), we will not disclose the Sensitive Data to any person for any reason without your express prior consent.
- Invalidity/Unenforceability
If any part of the Conditions is found by a court or any competent authority to be invalid, unlawful or unenforceable then such part shall be severed from the remainder of the Conditions which shall continue to be valid and enforceable to the fullest extent permitted by law.
- Governing Law And Jurisdiction
10.1 We will only write and communicate with you in English.
10.2 English law governs these Conditions and all aspects of our relationship, unless your address you give us when purchasing the Gift Card is in Scotland, when Scottish law applies or in Ireland, when Irish law applies.
- Status
11.1 Cineworld Cinemas Limited (company registered number 01915767, registered office 7th Floor, 90 High Holborn, London WC1V 6XX) operates cinemas in the United Kingdom and the Channel Islands.
11.2 Adelphi Carlton Limited, trading as Cineworld Cinemas (registered number 7640, registered office 84 Northumberland Road, Ballsbridge, Dublin 4) operates cinemas in Ireland.
Unlimited Terms And Conditions
- Introduction
1.1 The Conditions and the Privacy Policy apply to all Unlimited Cards. You will be required to confirm that You agree to be bound by the Conditions during the purchase process. Please read them carefully and make sure that You understand them before You sign up. They do not affect your legal rights.
1.2 Cineworld may change the Conditions at any time as described in clause 10 below.
1.3 The Conditions were last updated on 15 April 2011. We recommend that You print and keep a copy of these Conditions for future reference if You have applied for an Unlimited Card on Cineworld’s website. - Definitions
2.1 In the Conditions, the following words have the meanings set out against them:
Agreement: the agreement between You and Cineworld for the purchase and use of an Unlimited Card;
Cineworld: the company identified in either clause 4.2 or 4.3, as the case may be;
Cineworld Cinemas: all Cineworld cinemas owned and operated by Cineworld in the Territory, including the West End Cinemas;
Cineworld’s General Terms and Conditions: the general terms and conditions set out in Cineworld’s Entry Policy applying to customers' attendance at Cineworld’s Cinemas, as available from Cineworld Cinemas, the Unlimited Helpdesk or online at www.cineworld.com;
Conditions: these written terms and conditions;
Initial Period: a period of 12 months from the Start Date;
Legitimate Grounds: where the User is unable to use his or her Unlimited Card for a continuing period of two calendar months due to medical reasons or because the User’s permanent address moves to an address outside the Territory;
Privacy Policy: Cineworld’s privacy policy set out at www.cineworld.com/policy and which is also available from Cineworld Cinemas or the Unlimited Helpdesk;
Start Date: the date on which a temporary Unlimited Card is issued by Cineworld;
Subscription Period: the Initial Period and any extended period (whether for a month or a year) for which an Unlimited Card is purchased;
Territory: the United Kingdom, the Channel Islands and the Republic of Ireland;
Unlimited Card: one of the cards described in clause 6.1 giving the User access to Cineworld Cinemas in the Territory during the Subscription Period, subject to the Conditions;
Unlimited Helpdesk: the Unlimited Subscription Department Helpdesk whose contact details are: 0844 372 3445 (or 0818 304 204 if calling from Ireland), Unlimited Helpdesk, Cineworld Cinemas Limited, PO Box 6138, Wolverhampton WV1 9RP, UK and contactus@unlimitedcineworld.com;
User: the person named as such on the Unlimited Card;
West End Cinemas: the Cineworld West End cinemas which are currently Cineworld Chelsea, Cineworld Haymarket, Cineworld Fulham Road and Cineworld Shaftesbury Avenue. Details of any changes will be available from Cineworld Cinemas or by phoning the Unlimited Helpdesk;
You: the person who enters into an Agreement for the purchase of an Unlimited Card. - Application Process
3.1 You may apply for any number of Unlimited Cards for You or any other Users by completing the application form on Cineworld’s website or by submitting an application form at any Cineworld Cinema box office.
3.2 Cineworld will process your application(s) and will confirm whether or not your application(s) is/are accepted through its website or at the relevant Cineworld Cinema box office. Alternatively, Cineworld may decline all or part of your application for any reason, in which case Cineworld will notify You as soon as practicable.
3.3 The creation of an Agreement between You and Cineworld will only occur when Cineworld confirms acceptance of your application and issues details of the User’s temporary Unlimited Card (as per clause 6). If You have applied online and your application(s) is/are accepted, Cineworld will send You an email with details of the temporary Unlimited Card. You will need a printer in order to print off your temporary Unlimited Card.
3.4 When deciding whether or not to accept your application Cineworld may use certain information about You, including any received from credit reference agency checks. In particular, Cineworld may pass your details to credit reference agencies for them to check against certain public and private databases. Credit reference agencies may keep a record to use in future security checks. This helps to protect You and us against fraudulent transactions.
3.5 By applying for Unlimited Card(s), You confirm:
(i) You are legally capable of entering into a binding contract;
(ii) You are at least 18 years old; and
(iii) the User is resident in the UK or Ireland.3.6 You understand that by purchasing an Unlimited Card, You are committing to pay the full annual subscription fee for the Initial Period of 12 months. Payment of the full annual subscription fee may be made under Cineworld’s Monthly Payment Plan or Cineworld’s Annual Payment Plan. (See clause 8 below.)
3.7 If You pay in accordance with the Annual Payment Plan, no refund of the annual subscription fee for the Initial Period which is paid in advance will be made unless You cancel the subscription under clauses 5 (Cancellation Rights), 10 (Changes), or 11 (Legitimate Grounds).
3.8 If You pay in accordance with the Monthly Payment Plan, You will have to pay all instalments of the annual subscription fee unless You cancel under clauses 5 (Cancellation Rights), 10 (Changes), or 11 (Legitimate Grounds). Failure to pay in accordance with the Monthly Payment Plan could result in your account being passed to debt collection.
3.9 Cineworld reserves the right to withdraw the paper based application process at any time without notice. - Agreement
4.1 The Agreement shall include your application form, the Conditions, Cineworld’s General Terms and Conditions and the Privacy Policy. No other terms shall apply.
4.2 If your residential address is in the UK, the Agreement will be with Cineworld Cinemas Limited, a company registered in England and Wales under company number 01915767 with registered address at 7th Floor, 90 High Holborn, London WC1V 6XX, United Kingdom and VAT number 606197048.
4.3 If your residential address is in the Republic of Ireland, the Agreement will be with Adelphi Carlton Limited (trading as Cineworld Cinemas), a company registered in the Republic of Ireland under company number 7640 with registered address at 84 Northumberland Road, Dublin 4, Ireland and VAT number 8B41247E. - Cancellation Rights
5.1 Cineworld may cancel the Agreement in the circumstances referred to in clause 12.
5.2 You may cancel the Agreement at any time before the end of the period of seven working days starting on the Start Date if You applied for an Unlimited Card online and the temporary Unlimited Card has not been used during that period. (For the purpose of this clause 5, “working day” means Monday to Friday, excluding any public or bank holiday on which the banks in England and Wales are closed.) This cancellation right is not available if You have applied for an Unlimited Card in person using a paper application form at a Cineworld Cinema.
5.3 To cancel, You will need to contact the Unlimited Helpdesk by email, phone or in writing within the time period set out in clause 5.2.
5.4 You will receive a full refund of any subscription fee paid, less an administration fee of £5 (or €8 if You are in Ireland). - Unlimited Cards
6.1 There are three types of Unlimited Card:
(i) the Unlimited West End Card, which is valid in all Cineworld Cinemas including West End Cinemas;
(ii) the Unlimited Card, which is valid in all Cineworld cinemas excluding West End cinemas; and
(iii) the Republic of Ireland Unlimited Card, which is valid in all Cineworld Cinemas including West End Cinemas.
6.2 The number, location and opening hours of Cineworld Cinemas in any area may change during the Subscription Period. A list of current Cineworld cinemas is available from www.cineworld.com or www.cineworld.ie or on written request to the Unlimited Helpdesk enclosing a stamped self-addressed envelope.
6.3 If your application is accepted, Cineworld will issue the User with a temporary card which will be valid for 28 days until the User receives his or her permanent card.
6.4 The permanent Unlimited Card will be valid from the Start Date, provided:
(i) it displays a head and shoulders photograph which is a clear and true likeness of the User; and
(ii) is signed by the User on the signature strip.
Inappropriate images may cause a delay in the processing of your application, for which Cineworld will not be responsible.
6.5 The Unlimited Card is not transferable and only the User will be entitled to use it at the relevant Cineworld Cinemas. - Terms Of Use For Unlimited Cards
7.1 The User accepts the Conditions and Cineworld’s General Terms and Conditions by using an Unlimited Card.
7.2 A valid Unlimited Card entitles the User to:
(i) access to the relevant Cineworld Cinemas every day of the week (subject to the Cineworld Cinema being open);
(ii) one seat (subject to availability and excluding VIP, Delux and other special or premium seating) for any film screening open to the general public (excluding premium screenings such as 3-D screenings);
(iii) one seat (subject to availability and excluding VIP, Delux and other special or premium seating) for 3-D screenings at a significantly discounted rate; and
(iv) one seat (subject to availability and excluding VIP, Delux and other special or premium seating) at such discounted rates for alternative content screenings as may be available from time to time.
7.3 All film screenings are subject to normal restrictions such as age certifications, and Cineworld’s General Terms and Conditions. The User shall have no preferential rights of access for any screenings except for special screenings organised for Unlimited Card users. The User is not entitled to use the Unlimited Card in conjunction with any other promotions offered by Cineworld unless otherwise stated and the Unlimited Card cannot be used to prove the User’s age.
7.4 The User may only book a ticket in advance in person at the Cineworld Cinema on the day of the performance and may not book online or by telephone.
7.5 To use the Unlimited Card, the User must present it at a Cineworld Cinema box office. The Unlimited Card will be scanned to check its validity and additional identification may be requested. If the Unlimited Card is validated, the User will be issued with a ticket for the chosen screening and time, subject to availability. If the Unlimited Card is not validated, the User may be advised to contact the Unlimited Helpdesk, for data protection reasons. The Unlimited Card must be shown again when the tickets are checked before entering the relevant auditorium. Entrance will not be permitted without the User presenting the Unlimited Card.
7.6 The Unlimited Card is only valid for one performance at any one time and cannot be used to obtain a ticket for another performance before the film presentation for which it has been used comes to an end.
7.7 The Unlimited Card will be valid from the Start Date for the Initial Period unless terminated by You or Cineworld under clauses 5.2, 10, 11 or 12. - Payment Of Annual Subscription Fees
8.1 The annual subscription fee for the Initial Period and renewal fees for each type of Unlimited Card are available from Cineworld’s website, Cineworld Cinemas and the Unlimited Helpdesk. The annual subscription fee must be paid in advance under the Annual Payment Plan or, by instalment under the Monthly Payment Plan, but in either case must be paid in full for the whole Initial Period.
8.2 Cineworld reserves the right to increase the annual subscription fee payable by instalment under the Monthly Payment Plan to reflect the cost to Cineworld of accepting payment by instalment. Such changes shall not take effect during the Initial Period and shall be notified to You in writing and at least one month before they come into effect.
8.3 Monthly Payment Plan
8.3.1 Under the Monthly Payment Plan, You agree to pay the full annual subscription fee for the Initial Period in 12 equal monthly instalments during the Initial Period.
8.3.2 (a) When Cineworld accepts your application for an Unlimited Card, You shall pay the following amount by credit card, debit card, Cineworld voucher, gift card or cash (vouchers, gift cards and cash may only be used at Cineworld Cinema box offices and only if the application is being made in paper form):
(i) if the User is a UK resident, the first month's instalment; or
(ii) if the User is a resident in Ireland, the first two months’ instalments.
(b) Each instalment for the remaining months shall be paid in advance by Direct Debit from a nominated bank account. You will need to fill in the Direct Debit instruction included in the Agreement correctly prior to submitting your application form. Each payment will be debited on the same day of each month, being the same day of the month that the first instalment was paid. If this date falls on a weekend or a bank holiday, or if there is no day of the same date in any month (e.g. 30 February) payment will be debited by your bank on the previous or next working day. Please check with your bank for details.
8.3.3 Unless You cancel your subscription at the end of the Initial Period in accordance with the Agreement, the Subscription Period will automatically be extended after the Initial Period if You continue to pay the monthly fee each month.
8.3.4 If You want to change the bank account to be debited, You must telephone the Unlimited Helpline to provide the new Direct Debit details and give Cineworld at least three weeks to process this change.
8.3.5 If, during the Initial Period, Cineworld does not receive any monthly payment or You seek to terminate the Agreement except as permitted in clauses 10 or 11, Cineworld may terminate the Agreement and deactivate the Unlimited Card as described in clause 12 below. Cineworld will be entitled to recover damages from You, which may include its reasonable administration expenses caused by the incident and the fees and expenses (including those of debt collectors) that Cineworld may reasonably and properly incur to recover the outstanding subscription fees which are due to Cineworld under the Agreement for the remainder of the Initial Period.
8.4 Annual Payment Plan
8.4.1 Under the Annual Payment Plan, You agree to pay the annual subscription fee for the Initial Period in a single advance payment.
8.4.2 You may pay the annual subscription fee by debit card, credit card, Cineworld voucher, gift card or cash (vouchers, gift cards and cash may only be used at Cineworld Cinema box offices and only if the application is being made in paper form).
8.4.3 At least six weeks before the end of the Initial Period, Cineworld will offer You the opportunity to pay the subscription fee for the next year by debit or credit card, or to move to the Monthly Payment Plan.
8.4.4 If this Agreement is terminated during the Initial Period (or any Subscription Period) on Legitimate Grounds (as described in clause 11), Cineworld will refund the amount paid for any full months remaining less one month.
8.5 Extending your Unlimited Card
8.5.1 If You extend the Subscription Period after the Initial Period, the fees for both the Monthly Payment Plan and the Annual Payment Plan will be those in force on the date the Initial Period expires. - Lost, Stolen Or Defective Cards
9.1 The User will need to telephone the Unlimited Helpdesk as soon as possible to report any lost or stolen Unlimited Card.
9.2 If the Unlimited Card is lost or stolen, Cineworld will charge an administration fee to replace it. The charge is currently £10.00 (or €16.00 if You are in Ireland) but this may be changed by Cineworld to reflect its administration costs. Once the fee is paid, Cineworld will send a replacement card to the User.
9.3 If the subscription is paid by Direct Debit, the amount of the administration fee will be debited directly from your bank account. If a Direct Debit is not in place, You will need to pay the administration fee before Cineworld will send out a new card.
9.4 If the card is defective, the User must return it to Unlimited Helpdesk as soon as possible for a free replacement. Cineworld’s liability in such cases is expressly limited to replacement of the defective Unlimited Card.
9.5 For the avoidance of doubt, no refunds will be given for cinema tickets purchased by the User between the date the card was lost or stolen or a replacement card was requested and the date the User receives his or her new card. Users will not be entitled to an Unlimited ticket until the replacement card has been received and is presented to the Cineworld Cinema box office in accordance with clause 7.5. - Changes
10.1 Subscription fees may be increased by Cineworld to reflect changes in standard ticket prices, inflation, Cineworld’s costs, additional taxes and costs that are not imposed by Cineworld. Any increase in the subscription fee will be notified to You at least one month before it comes into effect. Increases shall not take effect during any Initial Period, except as described in clause 10.2.
10.2 If there is a change in the rate of VAT or any other tax, or any other tax is imposed, Cineworld will be entitled to change the subscription fees to reflect such changes, at any time including during the Initial Period. This change will only affect You during the Initial Period if You are on the Monthly Payment Plan. Cineworld will give not less than one month’s notice of any increase and the Direct Debit amounts after expiry of such notice will be adjusted accordingly. Any other changes shall take effect as described in the remainder of this clause 10.
10.3 If You have extended the Subscription Period beyond any Initial Period increases in the subscription fees will take effect after expiry of any notice given by Cineworld under clause 10.1 or 10.2 as follows:
(i) if You pay the fees under the Monthly Payment Plan, the Direct Debit amounts after expiry of the notice will be adjusted accordingly;
(ii) if You pay the fees in advance, the increase will take effect at the end of the period for which fees have been paid.
10.4 Cineworld reserves the right to make changes to the Conditions on giving You at least one month’s prior written notice.
10.5 If:
(i) You are on the Monthly Payment Plan and these changes either increase the monthly instalment payable or are otherwise to your disadvantage during the Initial Period, or
(ii) You are on the Annual Payment Plan and the changes are to your disadvantage,
You will have 30 days from the notice date in which to terminate the Agreement.
10.6 If You terminate the Agreement under clause 10.5 and You are on the Monthly Payment Plan, You may stop making payments from one month after the date of the direct debit which follows You telling us you wish to terminate. If You are on the Annual Payment Plan, Cineworld will repay You an amount equal to the value of the remaining full months' subscription fee less one month. - Termination By You
11.1 You may terminate the Agreement during the Initial Period only on Legitimate Grounds. You must notify Cineworld in writing of your request to terminate, stating the reason for termination and enclosing any supporting evidence. The application must be made by post or via email to the Unlimited Helpdesk.
11.2 If Cineworld accepts that the User has Legitimate Grounds and You are on the Monthly Payment Plan, the Agreement will terminate one month after the date of the Direct Debit which follows receipt of the application referred to in clause 11.1 by the Unlimited Helpdesk. If you are on the Annual Payment Plan, Cineworld will repay You an amount equal to the value of the remaining full months' subscription fee less one month.
11.3 If Cineworld does not accept the request for termination, the Agreement shall continue in force. If You are on the Monthly Payment Plan, You must continue to pay the subscription fee for the remainder of the Initial Period. If You are on the Annual Payment Plan, You will not be entitled to any refund of the subscription fee.
11.4 In the event of termination on Legitimate Grounds, neither You nor the User may re-subscribe for an Unlimited Card until 6 months after the termination date.
11.5 If You are on a Monthly Payment Plan, You may terminate the Agreement at any time after the Initial Period by giving one full month’s notice. Notice must be given to the Unlimited Helpdesk in writing by post or via email. Termination will take effect one month after the date of the Direct Debit which follows receipt of Your notice to terminate. PLEASE NOTE: due to Cineworld’s current payment processes, if You are paying by Direct Debit, any Unlimited Card will be automatically deactivated if You cancel the Direct Debit. If You wish to cancel your Direct Debit, please do not do so until after the date on which your Unlimited Card expires or terminates. Cineworld will confirm this date in writing on receipt of your termination notice.
11.6 If You have extended the Subscription Period for a full year after the Initial Period and have paid under the Annual Payment Plan, You may cancel the Unlimited Card on one months’ notice and Cineworld will refund the fees paid for any remaining full months after the termination date. You may cancel by contacting the Unlimited Helpdesk by email, phone or in writing.
11.7 Additionally, You may terminate the Agreement at any time if Cineworld commits a serious breach of the Agreement.
11.8 On termination, the Unlimited Card will be de-activated and, if payment is made by Direct Debit, the debits will be stopped and any refunds due will be paid. - Suspension And Termination By Us
12.1 Cineworld may suspend the Agreement and temporarily deactivate the Unlimited Card if:
(i) You miss any payment. Cineworld will contact You by email or letter and if payment is made on request, Cineworld will reactivate the Unlimited Card within 48 hours of payment. Users will not be entitled to an Unlimited ticket until the Unlimited Card has been reactivated and, for the avoidance of doubt, no refunds will be given for cinema tickets purchased by the User between the date the Unlimited Card is deactivated until the date it is reactivated;
(ii) Cineworld suspects any fraud in any matter connected to entering into or performing the Agreement including providing false information on the application form; or
(iii) the User breaches any of Cineworld’s General Terms and Conditions.
12.2 Cineworld may terminate the Agreement immediately on any one of the following grounds:
(i) for your fraud (or our reasonable suspicion of your fraud) in any matter connected to entering into or performing the Agreement including providing any false information on the application form;
(ii) in the event of fraudulent or persistent or serious misuse of the Unlimited Card;
(iii) if You miss a payment and fail to make that payment within 28 days of a request from Cineworld to make it, or if You miss more than one payment;
(iv) material breach of the Agreement by You or the User that has not been corrected by You within a reasonable time.
12.3 If Cineworld terminates the Agreement under this clause 12, Cineworld may keep any subscription payments that have been received. Where You are on the Annual Payment Plan, Cineworld may refund any subscription fees paid for any full months after the termination date but shall be entitled to retain a fair amount to reflect the loss to Cineworld from terminating the Agreement in such circumstances. This right does not limit any other rights Cineworld may have against You.
12.4 On termination, Cineworld will deactivate the Unlimited Card.
12.5 Cineworld reserves the right to terminate, withdraw or suspend the Unlimited Card subscription arrangements, and the Agreement, at any time for any reason on reasonable notice in writing to You. Cineworld will refund the fees paid by You in advance for any remaining full months after the termination date. - Questions And Complaints
Any questions or complaints You may have in relation to the Unlimited Card or a notification of change in your circumstances should be directed to the Unlimited Helpdesk.
- Information Provided
You confirm that the information You provide about You and the User (including contact information) (Personal Information) is accurate and complete and that You are authorised to provide such Personal Information. It is your responsibility to ensure that such Personal Information is kept up to date, and Cineworld will not be responsible for errors or omissions in your Personal Information at any time. You may update your details at any time by contacting the Unlimited Helpdesk. The terms of the Privacy Policy apply to our use of Personal Information. In addition, You authorise Cineworld to (i) transfer or disclose Personal Information to professional advisers and such other parties as is necessary for the administration of Cineworld’s business (including financial decisions), customer profile research or if required to disclose such information required by law; and (ii) use any Personal Information to provide You and the User with information about your membership account, offers, products and/or services offered by Cineworld from time to time. You and the User may choose to opt-out of being contacted by Cineworld by ticking the opt-out box on the application form or notifying the Unlimited Helpdesk at any time during the Agreement.
- Cineworld's Liability
15.1 Cineworld Cinemas may be closed on a permanent or temporary basis from time to time, including for refurbishment or due to a Force Majeure Event (as described below). Details of such closures can be found on Cineworld’s website or by calling the Unlimited Helpdesk.
15.2 Cineworld will not be liable or responsible for any failure to perform, or delay in performance, that is caused by events outside its reasonable control (Force Majeure Event), including any act, event, non-happening, omission or accident which may be due to the following:
(i) Strikes, lock-outs or other industrial action;
(ii) Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war or threat or preparation for war;
(iii) Fire, explosion, adverse weather, snow fall, ice, storm, flood, earthquake, subsidence, epidemic or other natural disaster;
(iv) Disruption to or failure of the railways, shipping, aircraft, motor transport or other means of public or private transport;
(v) Disruption to or failure of public or private telecommunications networks or utility supplies;
(vi) Closure or limited access to Cineworld Cinemas on the grounds of Cineworld’s reasonable health and safety concerns;
(vii) Any governmental act, decree, legislation, regulation or restriction.
15.3 Cineworld’s liability for faulty Unlimited Cards is limited to the remedies described in clause 9.
15.4 Cineworld’s liability for its breach of the Agreement is limited to the annual subscription fee.
15.5 Cineworld will not in any event be liable for: (a) any loss of profit, revenue, business, contract, goodwill, or other financial or economic loss or damage; or (b) any indirect loss or damage which is not reasonably foreseeable as likely to occur in the ordinary course of events.
15.6 Cineworld does not exclude or restrict its liability for fraud, for death or personal injury resulting from its negligence or that of its agents or for any other liability that it cannot restrict or exclude by law, and nothing in this clause 15 shall operate to exclude, restrict or limit this liability. - General
16.1 The Agreement and any disputes or claims arising out of or in connection with it (including non-contractual disputes or claims) are governed by the laws of England and Wales and are subject to the non-exclusive jurisdiction of the courts of England and Wales, unless You live in Scotland, Northern Ireland or Ireland in which case the relevant law will apply and You can choose to take action against Cineworld in your local courts.
16.2 Cineworld does not accept amendments by You to the Conditions. Any variations to the Conditions must be signed by one of Cineworld’s authorised signatories.
16.3 You and the User may not transfer any of your rights or obligations under the Agreement to another person without Cineworld’s prior written consent. Cineworld can transfer all or any part of its rights or obligations under the Agreement to another organisation but your and the User’s rights under the Agreement will not be affected.
16.4 If the Agreement is terminated by either party for any reason, neither party will lose any rights which have already accrued.
16.5 If, at any time, Cineworld does not require You to comply with any part of the Agreement, this will not prevent it from doing so in the future.
16.6 If any part of the Agreement is disallowed or held to be ineffective by any court or other competent body, the rest of the Agreement will not be affected. - Contact Details
