Website Terms Of Use

Introduction To The Terms And Conditions

 1.1 The following terms (the "Terms") apply to any use by a visitor (the "User") of the Cineworld Cinemas Limited Web Site (the "Web Site"), and should be read carefully before any such use.
 
1.2 By accessing or using the Web Site, the User accepts and agrees to be legally bound by these Terms and acknowledges that Cineworld Cinemas Limited, as the owner and operator of the Web Site, has the right to amend or vary these Terms and any of the contents of the Web Site from time to time at its sole discretion.  Amendments or variations will take effect when they are posted on the Web Site and, as a result, the User should check the current version of the Terms each time he/she uses the Web Site.  These Terms, as amended or varied from time to time, apply to all use of and access to the Web Site, both now and in the future.

1.3 Additional terms and conditions may apply for any purchases made through the Web Site.  If so, you will be prompted to view such additional terms and conditions on our Web Site at the time of such purchases and those terms and conditions will apply in addition to these Terms to the extent that the context permits.

General Disclaimer

2.1 Although Cineworld Cinemas Limited has attempted to provide accurate information on the Web Site, Cineworld Cinemas Limited assumes no responsibility for the accuracy or completeness of such information.  Except as stated elsewhere in these Terms the User releases Cineworld Cinemas Limited, its affiliates and subsidiaries (together “Cineworld”), and all of their officers, directors, agents and employees, from any liability, for any claims, losses or damages arising out of or in any way connected with the User's use of the Web Site. 

2.2 To the fullest extent permitted by law and except as stated elsewhere in these Terms, Cineworld shall not be liable to any person or entity for any direct, indirect, special, consequential or incidental damages, including (without limitation) lost profits or revenues, loss of opportunity, costs of replacement goods or services, loss or damage to data or business interruption, arising out of or related to:
(a)    any access to or use of or inability to access or use the Web Site, any other hyperlinked web site or any other information or product included or described within the Web Site; or
(b)    any person or entity's reliance on the information presented,
in each case whether arising in tort (including negligence), contract or otherwise even if the User has advised Cineworld of the possibility of such damages.

2.3 All information and content provided on the Web Site is provided "as is" without representation or warranty of any kind, either expressed or implied. Without limiting the foregoing, Cineworld does not represent or warrant that the Web Site or any of its contents are accurate, current, complete, free from technical or typographical errors, free from changes or harmful components introduced by third parties or free from periodic interruption or errors of any other type.  Cineworld may revise the information or change the products or services mentioned on the Web Site at any time without notice. Any mention of non-Cineworld products or services is for information purposes only and constitutes neither an endorsement nor a recommendation of them. Neither Cineworld, nor their suppliers, make any representation or gives any warranty, condition or undertaking, expressed or implied, including (without limitation) as to the satisfactory quality, fitness for a particular purpose, suitability or non-infringement of any third party right or freedom from viruses, whether or not arising from a course of dealing, usage or trade practice.

2.4 Notwithstanding any other provision in these Terms, nothing within these Terms limits or restricts any person's liability for death or personal injury resulting from its negligence or that of its employees or agents.

2.5 These Terms and the User's use of the Web Site are governed by all applicable English law, unless the User's address provided when purchasing a ticket or other item online is in Scotland, when Scottish law applies. 

2.6 For any disputes arising out of or in connection with these Terms or the User's use of the Web Site, if the User's address provided when purchasing a ticket or other item online is in Scotland then the Scottish courts shall have non-exclusive jurisdiction, otherwise the English courts shall have non-exclusive jurisdiction.

2.7 Cineworld makes no representation that the content or materials on the Web Site are appropriate or available for use in other jurisdictions. Access to the Web Site's content or its materials from jurisdictions where such access is illegal is prohibited.  Users who choose to access the Web Site from other jurisdictions do so at their own initiative and risk and are responsible for compliance with all relevant local laws.  Cineworld is not responsible for any violations of law as a result of the User's actions. 

Trade Marks And Other Such Rights

3.1 The trade marks and logos ("Marks") displayed on the Web Site are the property of Cineworld or other third parties.  The User is not permitted to use these Marks without the prior written consent of Cineworld or the relevant third party proprietor of the Marks, and the User acknowledges that any such use may constitute an infringement of the relevant proprietor's rights.

3.2 The User acknowledges that all intellectual property rights in all materials on the Web Site remain the property of Cineworld or the relevant third party proprietor, licensor or other content owner.  Except as expressly permitted herein, no portion of the information on the Web Site may be reproduced in any form, or by any means, without prior written permission from the Mark owner.

Links To Third Party Web Sites

4.1 The Web Site contains links to third party web sites.  Access to any other web site through a link on the Web Site is at the User's own risk and Cineworld is not responsible for the accuracy or reliability of any information, data, opinions, advice or statements made on these sites or the security of any link or communication with those sites.

4.2 Cineworld reserves the right to terminate a link to a third party site at any time.

4.3 The provision of a link to a third party web site through the Web Site does not mean that Cineworld endorses, authorises or sponsors that web site nor does it mean that Cineworld is affiliated with the third party web site's owners or sponsors. Cineworld provides these links merely as a convenience for the User.

Online Ticket Purchases

5.1 The following terms apply if the User purchases tickets through the Web Site (which, for the purposes of these terms and conditions, will include purchases made using the Cineworld Iphone App, the Cineworld Android App, the Cineworld Mobile Site and the Cineworld Facebook Booking App). 

5.2 Cinema tickets are sold by Cineworld at standard prices for the relevant performance, although a discount to standard prices is currently available to mycineworld members who book via the Web Site using their mycineworld log-in (Cineworld reserves the right to withdraw or amend this offer regarding discounted tickets at anytime and without notice).  By requesting tickets through the Web Site, the User is placing a booking request for tickets on the Terms that is only deemed accepted by and binding on Cineworld once it has processed valid payment and sent the User email confirmation of the User's booking.

5.3 Currently, there is no booking fee payable in respect of tickets purchased via the Web Site.  This offer is valid until further notice and Cineworld reserves the right to reinstate a booking fee at any time and without notice. Tickets are sold at the prices stated on the Web Site at the time of purchase. Users should be aware that prices for tickets may change between the date of purchase and the date of the relevant performance. Where the price paid for the tickets differs to the price for equivalent tickets available for purchase at the time and date of the performance, Cineworld will not charge for and Users may not claim any refund of the difference.

5.4 The email confirmation of a booking will set out the details of the cinema tickets purchased including the unique booking reference number (“booking reference”).  Once this confirmation has been sent, the ticket price is non-refundable.  Cineworld is not responsible in the event that the User selects the wrong film when booking tickets via the Web Site, or if the User is excluded from viewing the film under the conditions below.

5.5 The User can either print his/her cinema tickets at home or pick up his/her tickets immediately at his/her selected Cineworld cinema following confirmation of his/her booking. Where users collect tickets at the cinema, they must do so no later than 10 minutes following the start of the performance.  Any ticket booked online using an Unlimited card must be collected no later than 20 minutes before the advertised screening time on the day of the performance otherwise Cineworld may release it for general sale.

5.6 Tickets are dispensed in-cinema by one of our automatic ticket collection machines or can be collected at the Box Office or Ticket and Concession stand of the User's chosen Cineworld cinema.

5.7 The User will need to present the debit/credit/charge card that he/she used to make a booking or the booking reference in order to collect the relevant tickets in-cinema.   

5.8 Where Cineworld has advised the User that e-ticketing is available for a particular booking, the User may use the e-ticket (containing a QR code) attached to the email confirmation of booking (“e-ticket”) in the chosen Cineworld cinema as their cinema ticket.  The User may present their e-ticket on a mobile phone or on a print out at the relevant auditorium entry point for scanning  by a Cineworld staff member to gain entry for the User or, in the case of a group booking, the User’s group (please see clause 5.9 below for further conditions regarding group entry using one e-ticket).  If retail items have been ordered as part of the individual or group booking, the User must go to the Concession stand first to collect the retail items. E-ticketing is currently not available for tickets booked online using an Unlimited Card.

5.9 If an e-ticket is used to admit a group, all members of the group, including the User, must be admitted into the performance together and the User must be able to provide proof of ticket purchase for all members by showing the relevant e-ticket at all times during the group’s visit (including during a performance) if requested by Cineworld staff. 


5.10 If the User would prefer to use printed tickets and, if applicable, printed retail vouchers, they may present their e-ticket at an automated ticket collection machine or a Concession stand and request printed tickets and, if applicable, retail vouchers.  If tickets and, where applicable, retail vouchers are printed, the QR code on the e-ticket will no longer work and the printed tickets and vouchers must be used to enter the screen and collect retail items. Users should ensure that they arrive by the advertised performance time, as Cineworld reserves the right to refuse admission to customers who arrive after the start of the feature presentation

5.11 To make any payment by credit/debit/charge card, the User must provide the cardholder's name and email address, the card number, the card security code, the card expiry date and (where applicable) the card start date and/or issue number.

5.12 Transactions will appear on the cardholder's bank or card statement as a payment to Cineworld.co.uk for purchases in the UK and Cineworld.ie for purchases in Ireland.

5.13 For all concessions/student tickets, the User must bring proof of entitlement to the cinema as this may be required upon entry to the film or collection of tickets (where applicable).

5.14 Cineworld will endeavour to operate its cinemas in accordance with its advertised programme. However, there will be instances when its ability to show a performance is impaired by circumstances beyond its control. In such situations, Cineworld reserves the right to cancel a performance, vary the time it shows it or provide customers with an alternative performance.  If Cineworld does have to cancel a performance, the User’s sole remedy shall be a refund of the admission price paid for the relevant tickets, and no other costs.

5.15 Cineworld draws the User's attention to the conditions of, for performances in the UK, the British Board of Film Classification certificate and, for performances in Ireland, the Irish Film Classification Office certificate for the film being shown and is obliged to and will refuse admission to any person who, in the opinion of an authorised Cineworld employee or representative, is under the minimum age required for admittance. Cineworld reserve the right to request any individual to provide proof of age and to exclude any such individual from any performance if they appear too young and/or cannot prove they are at least minimum age for admittance.  In order for children under the age of 12 to be admitted after 7.00pm they must be accompanied by a parent or guardian.  Children under the age of 8 must be accompanied by someone who is at least 18 years of age at all times (regardless of the film classification).

5.16 Use of the tickets will be subject to the terms and conditions set out in the Cineworld Terms of Entry, which forms part of these Terms.

Online Purchases of Retail Items Offer (only available at certain cinemas)

6.1 In addition to the other sections of the Web Site Terms of Use, the following terms apply if the User purchases merchandise and/or food and beverages (“retail items”) through the Web Site.  The terms in this clause do not apply to purchases of tickets, Gift Cards, Gift Boxes, e-Gift Cards or the Unlimited Card, to which other terms apply.

6.2 By requesting retail items through the Web Site, the User is placing an order for a voucher (“concessions voucher”) to exchange for specific retail items in the User’s chosen Cineworld cinema on the Terms that the order is only deemed accepted by and binding on Cineworld once it has processed valid payment and sent the User email confirmation of the User's order.  Cineworld reserves the right not to accept orders.

6.3 The email confirmation of an order will attach the concessions voucher which will set out the details of the retail items selected together with a unique order reference number (“booking reference”).   Other than the rights to cancel during the cancellation period as detailed below, once this confirmation has been sent, the purchase price is non-refundable and no changes may be made to the order.  Cineworld is not responsible in the event that the User selects the wrong retail items when placing an order via the Web Site.

6.4 The User can pick up his/her retail items at the Snacks Counter of his/her selected Cineworld cinema following receipt of confirmation of his/her order.   

6.5 The User will need to present either (i) the printed concessions voucher or (ii) the booking reference, or (iii) the payment card used to place the order for the concessions voucher at the Snacks Counter of the chosen Cineworld cinema, in order to collect the relevant retail items. Where Cineworld has advised the User that e-ticketing is available for a particular booking, the User may present their e-ticket (containing a QR code) included in their email confirmation of an order on their mobile phone or on a print out for scanning by a Cineworld staff member at the Snacks Counter to collect the relevant retail items or request that their concessions voucher is printed.  Once concession vouchers have been printed the QR code on the e-ticket will no longer work and the printed concessions voucher must be used to collect retail items.  

6.6 When the User redeems all or part of the concessions voucher the retail items collected will be deducted from the balance on the concessions voucher.  The User must collect his/her retail items within 3 months of the date of purchase of the concessions voucher.  Any retail items included on the concessions voucher which are not collected within that 3 month period will be cancelled and no refund will be given. 

6.7 Cineworld will endeavour to supply all retail items specified on the concessions voucher on presentation of the relevant concessions voucher, but reserves the right to substitute the chosen retail items with alternative products of an equivalent or greater value where not available.

6.8 To make any payment by credit/debit/charge card, the User must provide the cardholder’s name and email address, the card number, the card security code, the card expiry date and (where applicable) the card start date and/or issue number.  Transactions will appear on the cardholder’s bank or card statement as a payment to cineworld.co.uk for purchases in UK or The Channel Islands and cineworld.ie for purchases in Ireland.

6.9 Retail items are sold at the prices for the relevant items as stated on the Web Site at the time of purchase of the concessions voucher.  Users should be aware that prices may change between the date of purchase and the date of collection of the retail items. Not all products, prices, offers and discounts for retail items available in-cinema will be available through the Web Site and not all products, prices, offers and discounts available on the Web Site will be available in-cinema. Except for our right to make substitutions (as set out above), concessions vouchers may only be redeemed for the retail items specified in the concessions voucher.  No difference in price paid at the time of purchase may be claimed where prices, offers and discounts differ in cinema to those on the Web Site, at the time of purchase of the concessions voucher or collection of retail items or otherwise.        

6.10 Concessions vouchers may not be exchanged for cash. Other taxes or costs may exist in relation to the concessions voucher that are not imposed by Cineworld.

6.11 The concessions voucher does not entitle the User to preferential treatment over other Cineworld customers for the collection of retail items.  

6.12 The User may cancel his/her order for retail items by cancelling the concessions voucher during the "Cancellation Period". This is the period during which the User may cancel the concessions voucher, commencing on the date of purchase and ending the earlier of:

6.12.1 fourteen calendar days from (and including) the day after the date on which the User receives the email confirmation of the User’s order; or

6.12.2 the date on which the concessions voucher is used.

6.13 If the User wishes to cancel his/her order for the concessions voucher, he/she should write to the Customer Services Department at Power Road Studios, Power Road, Chiswick, London W4 5RP or email customer.services@cineworld.co.uk or telephone on 0844 815 7747 (+442087**4010 if calling from Ireland) stating the booking reference detailed on the concessions voucher.  Once the Cancellation Period has expired the User will not be able to cancel his/her purchase or claim a refund of the value of the concessions voucher.

6.14 Except as expressly provided in these Terms, all warranties, conditions or other terms in favour of the User or any other person who uses the concessions voucher implied by Statute or common law are excluded to the fullest extent permitted by law.  Nothing in these terms is intended nor shall it be construed to limit our liability for fraud or death or for personal injury caused by Cineworld’s negligence.

6.15 Cineworld shall not be liable to the User or any other person who uses the concessions voucher  by reason of any failure or delay in performing any of its obligations in relation to issue or redemption of the concessions voucher or the User’s request for retail items through the Web Site under these terms if the failure or delay was due to any cause beyond Cineworld’s reasonable control.

6.16 Cineworld’s liability to the User or any other person who uses the concessions voucher shall not exceed the amount paid by the User for the concessions voucher. No other out of court complaint or redress system or compensation scheme exists in relation to the concessions voucher or the purchase of retail items.

6.17 Where Unlimited customers are entitled to claim discounts on retail items, they must do so in-cinema as discounts may not be claimed for retail items or concessions vouchers ordered through the Web Site. 

6.18 Users will not be able to request retail items or order concessions vouchers through the Cineworld Mobile Site, the Cineworld iPhone App, the Cineworld Android App or the Cineworld Facebook Booking App.

6.19 English law governs these terms and all aspects of the relationship between Cineworld and the User for the purchase of the concessions voucher, unless the address the User gives to Cineworld when placing his/her order for a concessions voucher is in Scotland, when Scottish law applies or in Ireland, when Irish law applies. Cineworld will only write and communicate with the User in English.

6.20 If the User’s residential address is in the UK or The Channel Islands, the agreement for the purchase of the concessions voucher will be with Cineworld Cinemas Limited (company registered number 01915767), registered office Power Road Studios, 114 Power Road, Chiswick, London W4 5PY).  If the residential address is in Ireland the agreement for the purchase of the concessions voucher will be with Adelphi Carlton Limited, trading as Cineworld Cinemas, (registered number 7640, registered office 5th Floor, Block E, Iveagh Court, Harcourt Road, Dublin 2, Ireland). 

6.21 All complaints or queries should be addressed to the Cineworld Customer Services Department in writing at Power Road Studios, Power Road, Chiswick, London W4 5PY, or by email to customer.services@cineworld.co.uk  or by phone 0844 715 7747 (+208 742 4010 if calling from Ireland). 

Prices, Payment and VAT

7.1 Purchases made via the Web Site must be paid for using debit, credit or charge card or Cineworld Gift Cards or e-Gift Cards (where available).

7.2 All prices displayed on the Web Site (unless otherwise stated) are inclusive of VAT (where applicable).

7.3 All transaction details, including payment card details, are encrypted using Secure Sockets Layer. Further, Cineworld seeks to ensure that bank details are never transmitted in clear text through the Cineworld booking system.

Web Site Security

8.1 The User agrees not to corrupt (or attempt to corrupt) any data or to circumvent (or attempt to circumvent) any of the security safeguards of Cineworld or any of its suppliers.

8.2 The User acknowledges that the Internet is not entirely secure and whilst Cineworld will take all reasonable steps to safeguard the security of any payment card information the User imparts through encryption methods, Cineworld shall not be liable for any damage that the User may suffer as a result of the loss of confidentiality of any such information.

Access To mycineworld

9.1 Access to the mycineworld area of the Web Site is restricted to authorised Users only. Unauthorised individuals attempting to access the mycineworld part of the Web Site may be subject to prosecution.

9.2 The User is solely responsible in all respects for any use of the username and password which the User selects at the time he/she registers for the mycineworld area.  The User must not share their password with, or transfer it to, any third parties.

9.3 If the User becomes aware of any unauthorised use of their username and password, they must notify Cineworld immediately either by emailing customer.services@cineworld.co.uk, or by telephoning 0844 815 7747.  Cineworld will not be responsible for any such unauthorised use.      

9.4 Cineworld reserves the right to withdraw or amend any offers made to Users and/or persons registered with mycineworld at any time and without notice, including in relation to the level of mycineworld online discount being offered and the application of a booking fee.

9.5 Users who opt to use Facebook Connect when registering to mycineworld will also be subject to Facebook’s terms and conditions of use and privacy policy, for which Cineworld is not responsible.

9.6  Users will not be able to amend or update their mycineworld account settings, or register using Facebook Connect, through the Cineworld Mobile Site, the Cineworld iPhone App or the Cineworld Android App (although they will be able to obtain tickets at the mycineworld discounted price using these channels).

Privacy

10.1 The User acknowledges that Cineworld is entitled to handle any personal information that the User supplies when using the Web Site in accordance with the Privacy Policy, which forms part of these Terms.

Miscellaneous

11.1 The failure of Cineworld to insist upon or enforce strict performance of any provision of these Terms shall not be construed as a waiver of any provision or right.

11.2 Cineworld may assign, transfer or, where permitted by law, declare a trust over the benefit of its rights and obligations under these Terms to any party at any time without notice to the User.  The User may not assign, transfer or declare a trust over his/her rights or obligations under these Terms without Cineworld's prior written consent, which may be withheld at its absolute discretion.

11.3 Cineworld will not be in breach of these Terms or otherwise liable for any delay in performance of them to the extent that such breach or delay is due to circumstances beyond its reasonable control.

11.4 If any part of these Terms is unenforceable, invalid or illegal (including any provision in which Cineworld excludes its liability to the User), the enforceability, validity or legality of any other part of these Terms will not be affected or impaired in any way.

1.5 These Terms embody and set forth the entire agreement and understanding between Cineworld and the User and supersede all prior oral representations (including negligent representations) or written agreements, understandings or arrangements with respect to the subject matter hereof. Neither party shall be entitled to rely on any agreement, understanding or arrangement which is not expressly set forth in these Terms. The provisions of this clause shall not exclude any liability or any right which either party may have in respect of any statements made fraudulently prior to User's acceptance of these Terms or any fraudulent concealment by the other.

11.6 Any notice to be given by either party to the other may be sent by email or recorded delivery to the address of the other.  In the case of Cineworld, this address shall be Cineworld Cinemas, Power Road Studios, Power Road, Chiswick, London W4 5PY, or by email to customer.services@cineworld.co.uk, each as amended herein from time to time.  In the case of the User, such an address shall be that provided at the time of registration or such other address as the User may from time to time have communicated to Cineworld in writing or by email to customer.services@cineworld.co.uk.  If sent by email, a notice shall be deemed to be received on the day it was sent or, if sent by recorded delivery, shall be deemed to be served two days following the date of posting.

11.7 Some of the provisions of these Terms are for the benefit of Cineworld and its officers, directors, employees, agents, subsidiaries, affiliates, suppliers and third party information providers.  Each of these persons or entities shall have the right to assert and enforce those provisions directly against the User on its own behalf if the User violates any of these Terms.  Save for the foregoing, the Contracts (Rights of Third Parties) Act 1999 shall not apply to these Terms and no rights or benefits expressly or impliedly conferred by them shall be enforceable under that Act against the parties by any other person.

Cineworld Cinema’s Terms of Entry

Introduction

 1.1 Cineworld wants all of its customers to enjoy their visit to its cinemas.  To help ensure this, admission to any Cineworld cinema is subject to the following terms and conditions. By purchasing or using a Cineworld cinema ticket, customers (including Unlimited Card holders) agree to be bound by these terms and conditions.

Key Points

2.1 Behaviour: Cineworld reserves the right to require customers who are disruptive, antisocial or violent to leave the cinema immediately without any entitlement to a refund. What constitutes disruptive, antisocial or violent behaviour shall be determined at the sole discretion of the Cineworld Duty Manager and includes both physical and verbal abuse.

2.2 Alcohol and Food Policy: Neither alcohol nor hot food may be brought onto the premises.  Only hot food bought on the premises may be consumed on the premises.  Alcohol may only be purchased and consumed in Cineworld licensed bar areas or in licensed screens and licensing laws will be strictly enforced.

2.3 Mobile Devices: All mobile devices including mobile telephones must be switched off at all times during the feature presentation.

2.4 Piracy: Customers are not allowed to bring any form of recording or copying equipment (in whatever medium, including optical devices such as Google Glasses) into the auditorium. Recording or copying equipment taken into the auditorium may be confiscated for inspection by the Cineworld Duty Manager. Customers are reminded that it is a serious criminal offence to copy or attempt to copy any film, soundtrack or other copyright protected material shown in the auditorium and customers found in contravention will be liable on conviction to an unlimited fine and imprisonment of up to 10 years.

2.5 Certification: Cineworld is not responsible for the certification of adverts, trailers or films. All complaints in respect of the wrongful classification of any of these items should be directed to the British Board of Film Classification (the BBFC).

2.6 Search Policy: Cineworld reserves the right to search a customer’s possessions whilst on the premises for any item which a staff member believes may contravene these terms and conditions. Customers must consent to being searched for any item which a staff member believes may contravene these terms and conditions. Cineworld reserves the right to refuse entry or require a customer to leave without entitlement to a refund if consent is not given.

2.7 Parking: Cineworld is not responsible for the parking regulations imposed by third parties, including any cost imposed on customers. Customers should take up any issues directly with the third party concerned.

2.8 Refunds: Tickets purchased for performances at a Cineworld cinema are non-refundable. Ticket prices may change between the date of purchase and the date of the relevant performance.  Where the price paid for the tickets differs to the price for equivalent tickets available for purchase at the time and date of the performance, Cineworld will not charge for and customers may not claim any refund of the difference.

Entry Into The Cinema

3.1 Only customers in possession of a valid ticket will be admitted into the auditorium to which the ticket relates and admission will be permitted only for the duration of the performance specified by the ticket. At the time of collection, customers should check that the ticket’s details are correct as tickets cannot be later exchanged or refunded in the event of any error.

3.2 Lost, stolen or damaged tickets will not be replaced. Any customer who does not hold a valid ticket may be required to leave the premises.

3.3 Customers should keep the ticket stubs or e-tickets with them at all times in order to re-enter the relevant auditorium.

3.4 Cineworld will refuse admission to any person who, in the opinion of an authorised Cineworld employee or representative, is under the minimum age required by the BBFC classification for a presentation and cannot prove that they are at least the minimum age required. Cineworld expressly reserves the right to request photographic identification verifying the age of the customer (e.g. a driving licence or passport) for entry into 12A, 15 and 18 certificated films.  Photocopies of birth certificates, (together with a form of photographic identification connecting the name on the birth certificate to the customer), passports and driving licences are acceptable.  Children under the age of 12 must be accompanied by someone who is at least 18 years of age to be admitted after 7.00pm. Children under the age of 8 must be accompanied by someone who is at least 18 years of age at all times (regardless of film classification).

3.5 Student tickets are available at certain times on specified days.  Student tickets will only be issued upon the production of valid National Union of Students photographic identification showing a clear photograph of the student and the applicable expiry date of the identification. Student tickets will be limited to one per student. Photographic identification may be checked before admission to the auditorium in the case of pre-booked tickets.

3.6 Customers aged 15, 16 or 17 are entitled to student tickets (when and where available) without presenting student identification, however they may be required to provide identification in order to verify their age.

3.7 Seniors tickets are available at certain times on specified days. Seniors tickets will only be issued upon the production of valid senior card, senior bus pass / Freedom pass or state pension letter.  Senior tickets will be limited to one per senior.  Proof of entitlement and identification may be checked before admission to the auditorium in the case of pre-booked tickets.

3.8 Carers of disabled customers are entitled to a free ticket if the person they are accompanying can show a valid Cinema Exhibitors’ Association Card (CEA card) or locally issued disability card. Please see www.ceacard.co.uk for the full terms of use. Guide and Hearing dogs are welcome but other animals are not permitted on the premises.

3.9 In order to avoid disturbing other customers, customers who arrive after the start of the feature presentation will only be permitted entry into the auditorium at the Cinema Duty Manager’s sole discretion.

Our Obligations

4.1 Although Cineworld seeks to follow its advertised programme, it reserves the right to cancel or reschedule a performance or to substitute an alternative film or presentation, if forced to do so by circumstances beyond its control.

4.2 If a film showing or other presentation is cancelled, rescheduled or substituted, the Cinema Duty Manager will have the sole discretion to decide whether to refund customers the cost of their tickets or to issue replacement tickets for the same film or presentation at an alternative time.

Safety And Security

5.1 Cineworld reserves the right to refuse the entry onto its premises of any person who is believed to be intoxicated and may require any person or customer who is believed to be intoxicated to leave the premises immediately without any entitlement to a refund.

5.2 No customer is allowed to bring any illegal substances or weapons onto the
premises. Anyone found in possession of such items will be refused entry or will be required to leave the premises immediately without any entitlement to a refund. Cineworld takes such matters seriously and may report the incident to the police.

5.3 In order to comply with applicable health and safety legislation, customers must at all times remain within the public areas of the premises and must not obstruct the aisles with personal belongings.

5.4 Customers must keep their personal belongings with them at all times. Cineworld accepts no responsibility for the loss, theft, alteration or damage to any personal items brought onto the premises.

5.5 Customers are not permitted to smoke on the premises of any Cineworld cinema this includes any form of electronic cigarette or other artificial smoking devices. Cineworld reserves the right to require any person or customer found to be in contravention of this rule to leave the premises immediately without any entitlement to a refund.

Other Matters

6.1 Nothing in these terms and conditions affects your statutory rights as a customer or excludes or limits Cineworld’s liability for fraud or for death or personal injury resulting from Cineworld’s negligence or for any other liability which Cineworld cannot exclude or limit under law but otherwise Cineworld’s liability to you as a customer shall be limited to the ticket price paid.

6.2 In addition to its other rights, in the event that a customer or group of customers breach or breaches any of the terms and conditions of this policy, Cineworld reserves the right to take such action as is necessary to prevent a reoccurrence of such breach (including recovering any costs incurred). Such action may include banning the relevant customer or customers from all Cineworld premises and/or taking legal action.

6.3 Cineworld reserves the right to charge for any additional service or product which it may supply including but not limited to 3D glasses.

6.4 Any Cineworld Duty Manager may refuse entry to any person onto the premises of the relevant Cineworld cinema at any time and will be under no obligation to provide a reason to that person.

6.5 Cineworld accepts no responsibility for any information displayed or broadcast on the premises by any third party.

6.6 Cineworld reserves the right to amend these terms and conditions from time to time without notice.

Definitions

In these Gift Card and e-Gift Card Conditions, the following words have the meanings set out against them:

Conditions: these Gift Card and e-Gift Card Conditions, Cineworld’s Web Site Terms of Use and Cineworld's Terms of Entry;

Cineworld's Terms of Entry: the general terms and conditions of Cineworld for customers' attendance at Cineworld's cinemas, as may be displayed at Cineworld cinemas or on its website under the heading Cineworld Cinema’s Terms of Entry;

Cineworld’s Web Site Terms of Use: the terms of use for customers’ use of the Cineworld web sites at www.cineworld.co.uk and www.cineworld.ie, as displayed on such web sites;

Customer Services Department: 0844 815 7747 (or +442087**4010 if calling from the Republic of Ireland); The Customer Services Department of Cineworld: Cineworld Customer Services, Power Road Studios, Power Road, Chiswick, London, W4 5PY, customer.services@cineworld.co.uk;

"e-Gift Box" (including Valentines e-Gift): a seasonal gift 'box' containing a selection of pre-paid codes contained within an email issued by Cineworld (“e-Gift Box Vouchers”) which can be redeemed for such cinema tickets, food and beverages as described in the e-Gift Box email during the relevant validity period (see condition 3.13 below).  e-Gift Box Vouchers for cinema tickets may only be redeemed online at www.cineworld.com (not valid for redemption in cinemas or on the Cineworld phone booking service or at The Screening Rooms).  e-Gift Box Vouchers for food and drink can be redeemed in selected Cineworld cinemas in the UK and the Republic of Ireland (not valid for redemption online or on the Cineworld phone booking service or at The Screening Rooms).

e-Gift Card: any Cineworld prepaid code contained within an attachment to an email issued by Cineworld (but not e-Gift Box Vouchers) which can be used to make purchases during the relevant validity period (see condition 3.19 below) on the Cineworld Web Site www.cineworld.co.uk or, where the prepayment was made in Euros, only on the Cineworld Ireland Web Site at www.cineworld.ie in accordance with these Conditions;

Gift Box: a seasonal gift box containing a selection of pre-paid paper vouchers (“Gift Box Vouchers”) issued by Cineworld which can be redeemed for such cinema tickets, food and beverages as described on the Gift Box Vouchers during the relevant validity period (see condition 3.8 below) in selected Cineworld cinemas in the United Kingdom or, if purchased in Euros, only in Cineworld cinemas in Ireland (not valid for redemption online or on the Cineworld phone booking service or at The Screening Rooms).

Gift Card: a pre-paid paper or plastic card voucher (but not Gift Box Vouchers) issued by Cineworld which can be used to make purchases during the relevant validity period (see condition 3.4 below) in selected Cineworld cinemas in the United Kingdom, The Channel Islands and on Cineworld’s Web Site at www.cineworld.co.uk, or where prepayment was made in Euros, only in Cineworld cinemas in Ireland and on Cineworld’s Web Site at www.cineworld.ie in accordance with these Conditions;

"Transaction Value": the value of any cinema tickets, merchandise, food and beverages and/or an Unlimited card purchased with the Gift Card or e-Gift Card;

we/us/our/Cineworld: (i) Cineworld Cinemas Limited if you are a UK or Channel Islands resident or (ii) Adelphi Carlton Limited (trading as Cineworld Cinemas) if you are resident in the Republic of Ireland;

you/your/yours: the person to whom the Gift Card, Gift Box or e-Gift Card is issued.

General

2.1 The Conditions apply to the purchase and use of all Gift Cards, Gift Boxes, e-Gift Boxes and e-Gift Cards and by purchasing the Gift Card, Gift Box, e-Gift Boxes or e-Gift Card you agree to be legally bound by the Conditions. We have the right to amend or vary these Conditions from time to time at our sole discretion but changes will not apply retrospectively.

Use Of Cineworld Gift Cards, Gift Boxes and e-Gift Cards

Gift Cards

3.1 The Gift Card is valid for use in Cineworld’s cinemas in the UK and The Channel Islands and the Screening Rooms in Cheltenham (which is owned by Cineworld Cinemas Limited) or on the Cineworld Web Site at www.cineworld.co.uk or, where pre-payment was made in Euros, only in Cineworld cinemas in the Republic of Ireland and at www.cineworld.ie. The value on the Gift Card can be used towards payment for the purchase of cinema tickets, food and beverages, merchandise or an Unlimited card in Cineworld cinemas and towards payment for the purchase of cinema tickets or an Unlimited card online.  Gift Cards may not be used to purchase other Gift Cards or e-Gift Cards or to make purchases on the Cineworld phone booking service.

3.2 You may give the Gift Card to anyone else to use but the Gift Card may not be re-sold. Please make sure that you and/or the recipient keep the Gift Card safe as anyone who presents the Gift Card or has access to the Gift Card number and PIN ("the User") will be able to redeem it.

3.3 Where the value on the Gift Card is less than the total Transaction Value, the User will be required to make up the difference in price (if redemption is on one of our web sites such payment will need to be by credit, debit, or charge card but may not be made using other Gift Cards or e-Gift Cards). 

3.4 Gift Card validity period: The Gift Card shall be valid for 24 months from the date of purchase or, if later, the date of the last card payment or top-up made.  Any balance unused in this 24 month period will be cancelled and no refund will be given.

3.5 When the Gift Card is used the amount of the Transaction Value will be deducted from the balance on the Gift Card. The remaining Gift Card balance will be displayed on the receipts issued when the User uses the card to make a purchase. The balance may also be checked in our cinemas at any till point or online at www.cineworld.co.uk/giftcards or www.cineworld.ie/giftcards (if in Euros).

Gift Boxes

3.6 Gift Box Vouchers are valid for use in Cineworld’s cinemas in the UK and Ireland (but not valid for redemption online or on the Cineworld phone booking service or at The Screening Rooms).  Gift Box Vouchers may only be redeemed for the specific type of cinema ticket or food and/or beverage item described on the face of the relevant voucher and may only be used once.  Gift Box Vouchers may not be exchanged for any other vouchers or items or be used in conjunction with any other offer or promotion.

3.7 You may give the Gift Box to anyone else to use but neither the Gift Box nor the Gift Box Vouchers may be re-sold. Please make sure that you and/or the recipient keep the Gift Box (and the Gift Box Vouchers) safe as anyone who presents the Gift Box Vouchers will be able to redeem them. No refunds or replacement vouchers will be issued to you or the User if the Gift Box Vouchers are lost or stolen.

3.8 Gift Box Vouchers validity period: Gift Box Vouchers are valid for the period stated on the face of the relevant Gift Box Voucher, namely from 26 December in the year of purchase until 30 June of the following year. Any Gift Box Vouchers not used within this time period will be cancelled and no refund or alternative vouchers will be provided.

3.9 To redeem a Gift Box Voucher the User must present the relevant Gift Box Voucher at the selected Cineworld cinema box office (for cinema tickets only) or at the Snacks Counter (for cinema tickets, food and beverages). On issue of the relevant cinema tickets and collection of the food and drink items the Gift Box Vouchers will be retained by us and cancelled.

3.10 Gift Boxes are an offer which Cineworld may make available from time to time at its discretion. Gift Boxes are sold on a first come first served basis and, therefore, are subject to availability. Cineworld reserves the right to refuse orders for Gift Boxes. Cineworld will endeavour to supply all food and drink items specified on the relevant Gift Box Vouchers, but reserves the right to substitute the food and drink items with alternative products of an equivalent or greater value where not available.

e-Gift Boxes

3.11 e-Gift Box Vouchers for cinema tickets are valid for use online at www.cineworld.com (not valid for redemption in cinemas or on the Cineworld phone booking service or at The Screening Rooms). e-Gift Box Vouchers for food and drink may only be used in cinemas (not online, on the Cineworld Phone Booking line or at The Screening Rooms). e-Gift Box Vouchers may only be redeemed for the specific type of cinema ticket or food and/or beverage item described in the e-Gift Box email and may only be used once. e-Gift Box Vouchers may not be exchanged for any other vouchers or items or be used in conjunction with any other offer or promotion.

3.12 You may give the e-Gift Box to anyone else to use but neither the e-Gift Box nor the e-Gift Box Vouchers may be re-sold. 3.14 To redeem an e-Gift Box Voucher for cinema tickets, the User must make a booking online at  www.cineworld.com  and enter the relevant e-Gift Box Voucher code where prompted (please see Condition 5 (Online Ticket purchases) of the Cineworld Website Terms of Use for more details). To redeem an e-Gift Box Voucher for food or drink and to collect the items the User will need to present the e-Gift Box email (containing the QR code) at the Snacks Counter in the cinema either on their mobile phone or on a paper print out for scanning by a Cineworld staff member. On issue of the relevant cinema tickets and collection of the food and drink items the e-Gift Box Vouchers will be cancelled.

3.15 e-Gift Boxes are an offer which Cineworld may make available from time to time at its discretion. e-Gift Boxes are sold on a first come first served basis and, therefore, are subject to availability. Cineworld reserves the right to refuse orders for e-Gift Boxes. 3.16 The e-Gift Card is valid for use on Cineworld’s Web Site at www.cineworld.co.uk, or where pre-payment was made in Euros, only at www.cineworld.ie.  The value on the e-Gift Card may be used towards payment for the purchase of cinema tickets and/or an Unlimited card sold on the above Web Sites. e-Gift Cards may not be used to purchase other e-Gift Cards or Gift Cards or to make purchases in any Cineworld cinemas or on the Cineworld phone booking service.

3.17 You may give the e-Gift Card to anyone else to use but the e-Gift Card may not be re-sold. Please make sure that you and/or the recipient keep the e-Gift Card safe as anyone who has access to the e-Gift Card prepaid code and PIN ("the User") will be able to redeem it.

3.18 Where the value on the e-Gift Card is less than the total Transaction Value, the User will be required to make up the difference in price by making an online payment using a debit, credit or charge card (but not another e-Gift Card or Gift Card).

3.19 e-Gift Card validity period: The e-Gift Card shall be valid for 12 months from the date of the last transaction made. Any balance unused in this 12 month period will be cancelled and no refund will be given.

3.20 When you use the e-Gift Card the amount of the Transaction Value will be deducted from the balance on the e-Gift Card. The remaining e-Gift Card balance will be displayed on screen and can be checked online at www.cineworld.co.uk/giftcards.

Gift Cards, Gift Boxes, e-Gift Boxes and e-Gift Cards

3.21 When a Gift Card or e-Gift Card is used to make a purchase online, the User will need to enter details of a debit, credit or charge card for identification and processing purposes

3.22 When a Gift Card or e-Gift Card is used to make a purchase online, or an e-Gift Box Voucher is redeemed online, the User will need to collect their cinema tickets at their chosen Cineworld cinema by presenting (i) the booking reference issued in the email from Cineworld confirming completion of the online transaction or (ii) the payment card used in connection with such online purchase. Alternatively, where e-ticketing is available for a particular booking, the User may use the e-ticket attached to the email confirmation of booking (“e-ticket”) and use that e-ticket in the chosen Cineworld cinema as their cinema ticket (please see Condition 5 (Online Ticket Purchases) of the Cineworld Website Terms of Use for more details).

3.23 Gift Cards, Gift Box Vouchers, e-Gift Box Vouchers and e-Gift Cards may not be exchanged for cash.

3.24 Defaced, illegible, or photocopied Gift Cards or Gift Box Vouchers will not be accepted.

3.25 Gift Cards, Gift Box Vouchers, e-Gift Box Vouchers and e-Gift Cards cannot be used to purchase cinema tickets through the Cineworld phone booking service.

3.26 The Gift Card, Gift Box Vouchers, e-Gift Box Vouchers or e-Gift Card does not entitle the User to preferential treatment over other Cineworld customers for the purchase of cinema tickets, merchandise, food and beverages and/or the Unlimited card, access to cinemas or otherwise.

3.27 The Gift Card, Gift Box Vouchers, e-Gift Box Vouchers or e-Gift Card does not entitle you to any credit or other form of financial accommodation.

3.28 Other taxes or costs may exist in relation to the Gift Card, Gift Box Vouchers, e-Gift Box Vouchers or e-Gift Card that are not imposed by us.

3.29 The number, location and availability of Cineworld cinemas in any area are subject to change. A list of current Cineworld cinemas is available from www.cineworld.com or on written request to the Customer Services Department enclosing a stamped self-addressed envelope.

Cancellation Rights

4.1 You may cancel the Gift Card, Gift Box, e-Gift Box or e-Gift Card during the "Cancellation Period", which commences on the date of purchase and ends on the earlier of:

(a) fourteen calendar days from (and including) the day after the date on which you receive our email confirming acceptance of your order; or

(b) the date on which the Gift Card, any of the Gift Box Vouchers or e-Gift Box Vouchers or the e-Gift Card is used.

4.2 If you wish to cancel a Gift Card or Gift Box, please send it by registered post to the Customer Services Department enclosing the Gift Card or Gift Box with your request to cancel. If you wish to cancel an e-Gift Card or e-Gift Box please write to, email or call the Customer Services Department stating the e-Gift Card code or the e-Gift Box Voucher codes and your wish to cancel. Once the Cancellation Period has expired you will not be able to cancel the Gift Card, Gift Box, e-Gift Box or e-Gift Card or claim a refund of the value of the Gift Card, Gift Box, e-Gift Box or e-Gift Card. You will be responsible for the cost of returning the Gift Card, Gift Box, e-Gift Box or e-Gift Card to us.

Defective Gift Cards and e-Gift Cards

5.1 If the Gift Card is defective, you must return it to the Customer Services Department as soon as possible for a free replacement. If the e-Gift Card code or an e-Gift Box Voucher code does not work, you must contact the Customer Services Department by phone or email as soon as possible so the e-Gift Card code or e-Gift Box Voucher code can be cancelled and a new e-Gift Card code or e-Gift Box Voucher code may be issued to you. Our liability in such cases is limited to replacement of the defective Gift Card or issue of a new e-Gift Card code or e-Gift Box Voucher code to the same value of the outstanding balance on the original Gift Card or e-Gift Card or e-Gift Box Voucher at the time of replacement.

Questions And Complaints

6.1 Any questions or complaints you may have in relation to the Gift Card, Gift Box , e-Gift Box or e-Gift Card should be directed to the Customer Services Department.

6.2 No other out of court complaint or redress system or compensation scheme exists in relation to the Gift Card, Gift Box, e-Gift Box or e-Gift Card.

Liability

7.1 Except as expressly provided in the Conditions, all warranties, conditions or other terms in favour of you or the User implied by Statute or common law are excluded to the fullest extent permitted by law.

7.2 Nothing in the Conditions is intended nor shall it be construed to limit our liability for fraud or death or for personal injury caused by our negligence.

7.3 We shall in no circumstances be liable if one or several Cineworld cinemas are closed permanently or temporarily or if a Cineworld website is unavailable, for whatever reason or if a particular film or item of merchandise, food or beverage is not available for whatever reason.

7.4 We shall not be liable to you or the User by reason of any failure or delay in performing any of our obligations in relation to the Gift Card, Gift Box, Gift Box Vouchers, e-Gift Box, e-Gift Box Vouchers or e-Gift Card under the Conditions if the failure or delay was due to any cause beyond our reasonable control.

7.5 We shall not be liable to you or the User in respect of any indirect or consequential loss, damage, costs or expenses or other claims for consequential compensation whatsoever which arise out of or in connection with the Gift Card, Gift Box, Gift Box Vouchers, e-Gift Box, e-Gift Box Vouchers or e-Gift Card.

7.6 Our liability to you or the User shall not exceed the amount paid by you for the Gift Card, Gift Box, e-Gift Box or e-Gift Card.

7.7 We shall not be liable to you or the User in the event of loss, theft, unauthorised use or re-sale of any Gift Card, e-Gift Card, Gift Box, e-Gift Box, e-Gift Box Vouchers or Gift Box Voucher.

Information Provided

8.1 You must ensure that the information you provide ("Personal Information") is accurate and complete. You acknowledge that Cineworld is entitled to handle any personal information that you supply when purchasing a Gift Card, Gift Box, e-Gift Box or e-Gift Card in accordance with our Privacy Policy on our Web Site, which forms part of these Conditions.

Invalidity/Unenforceability

If any part of the Conditions is found by a court or any competent authority to be invalid, unlawful or unenforceable then such part shall be severed from the remainder of the Conditions which shall continue to be valid and enforceable to the fullest extent permitted by law.

Governing Law And Jurisdiction

10.1 We will only write and communicate with you in English.

10.2 English law governs these Conditions and all aspects of our relationship, unless your address you give us when purchasing the Gift Card, Gift Box, e-Gift Box or e-Gift Card is in Scotland, when Scottish law applies or in the Republic of Ireland, when Irish law applies.

11.1 Cineworld Cinemas Limited (company registered number 01915767, registered office Power Road Studios, 114 Power Road, Chiswick, London W4 5PY) operates cinemas in the United Kingdom and the Channel Islands.

11.2 Adelphi Carlton Limited, trading as Cineworld Cinemas (registered number 7640, registered office 5th Floor, Block E, Iveagh Court, Harcourt Road, Dublin 2, Ireland) operates cinemas in the Republic of Ireland.

Unlimited Terms And Conditions - Applicable from 15th March 2013 (except for members who signed up before 15th March 2013 and are still within their initial/annual 12 month membership period (see T&Cs below))

Introduction

1.1 These Conditions and the Privacy Policy apply to all Unlimited Cards. You will be required to confirm that You agree to be bound by these Conditions during the purchase process. Please read them carefully and make sure that You understand them before You sign up. They do not affect your legal rights.

1.2 Cineworld may change these Conditions at any time as described in clause 10 below.

1.3 These Conditions were last updated on 15 March 2013. We recommend that You print and keep a copy of these Conditions for future reference.

Definitions

2.1 In these Conditions, the following words have the meanings set out against them:
Agreement: the agreement between You and Cineworld for the purchase and/or use of an Unlimited Card;

Cineworld: the company identified in either clause 4.2 or 4.3, as the case may be;

Cineworld Cinemas: all Cineworld cinemas owned and operated by Cineworld in the Territory, including the West End Cinemas;

Cineworld’s Terms of Entry: the general terms and conditions set out in Cineworld’s Terms of Entry applying to customers' attendance at Cineworld’s Cinemas, available from Cineworld Cinemas, the Unlimited Helpdesk or online at www.cineworld.com;

Conditions: these written terms and conditions;

Initial Period: a period of 12 months from the Start Date;

Legitimate Grounds: where the User is unable to use his or her Unlimited Card for a continuing period of two calendar months due to medical reasons or because the User’s permanent address moves to an address outside the Territory;

Privacy Policy: Cineworld’s privacy policy set out at www.cineworld.com/policy and which is also available from Cineworld Cinemas or the Unlimited Helpdesk;

Start Date: the date on which a temporary Unlimited Card is issued by Cineworld;

Subscription Period: the Initial Period and any extended period  for which an Unlimited Card is purchased;

Territory: the United Kingdom, the Channel Islands and the Republic of Ireland;

Unlimited Card: one of the cards described in clause 6.1 giving the User access to Cineworld Cinemas in the Territory during the Subscription Period, subject to the Conditions;

Unlimited Helpdesk: the Unlimited Subscription Department Helpdesk whose contact details are: 0844 372 3445 (or 0818 304 204 if calling from Ireland), Unlimited Helpdesk, Cineworld Cinemas Limited, PO Box 6138, Wolverhampton WV1 9RP, UK and contactus@unlimitedcineworld.com;

User: the person named as such on the Unlimited Card;

West End Cinemas: the Cineworld West End cinemas which are currently Cineworld Chelsea, Cineworld Haymarket, Cineworld Fulham Road and Cineworld Shaftesbury Avenue. Details of any changes will be available from Cineworld Cinemas or by phoning the Unlimited Helpdesk;

You: the person who enters into an Agreement for the purchase of an Unlimited Card.

Application Process

3.1 You may apply for any number of Unlimited Cards for You or any other Users by completing the application form on Cineworld’s website or by submitting an application form through an Unlimited terminal at selected Cineworld Cinemas.

3.2 Cineworld will process your application(s) and will confirm whether or not your application(s) is/are accepted through its website or the Unlimited terminal at the relevant Cineworld Cinema. Alternatively, Cineworld may decline all or part of your application at its discretion, in which case Cineworld will notify You as soon as practicable.

3.3 The creation of an Agreement between You and Cineworld will only occur when Cineworld confirms acceptance of your application and issues details of the User’s temporary Unlimited Card (as set out in clause 6). If You have applied online and your application(s) is/are accepted, Cineworld will send You an email with details of the temporary Unlimited Card. If You have applied online You will need a printer in order to print off your temporary Unlimited Card.  If You have applied using an Unlimited terminal in a Cineworld Cinema and your application(s) is/are accepted, Cineworld will send You an SMS with details of the temporary Unlimited Card.  You will need to display these details on your mobile phone at the Cineworld Cinema to use your membership prior to receipt of your permanent Unlimited Card.        

3.4 When deciding whether or not to accept your application Cineworld may use certain information about You, including any received from credit reference agency checks. In particular, Cineworld may pass your details to credit reference agencies for them to check against certain public and private databases. Credit reference agencies may keep a record to use in future security checks. This helps to protect You and us against fraudulent transactions.

3.5 By applying for Unlimited Card(s), You confirm:
(i) You are legally capable of entering into a binding contract;
(ii) You are at least 18 years old; and
(iii) the User is resident in the UK or Ireland.
If the User is under 18 You must complete the relevant section of the application form disclosing this fact otherwise he/she may receive marketing communications in respect of films with inappropriate ratings. 

3.6 You understand that by purchasing an Unlimited Card, You are committing to pay the full annual subscription fee for the Initial Period of 12 months. Payment of the full annual subscription fee may be made under Cineworld’s Monthly Payment Plan or Cineworld’s Annual Payment Plan. (See clause 8 below.)

3.7 If You pay in accordance with the Annual Payment Plan, no refund of the annual subscription fee for the Initial Period which is paid in advance will be made unless You cancel the subscription under clauses 5 (Your Cancellation Rights), 10 (Changes), or 11 (Legitimate Grounds).

3.8 If You pay in accordance with the Monthly Payment Plan, You will have to pay all 12 installments of the annual subscription fee unless You cancel under clauses 5 (Your Cancellation Rights), 10 (Changes), or 11 (Legitimate Grounds). Failure to pay in accordance with the Monthly Payment Plan could result in your account being passed to debt collection.

Agreement

4.1 The Agreement includes your application form, the Conditions, Cineworld’s Terms of Entry and the Privacy Policy. No other terms proposed by You or a User shall apply.

4.2 If your residential address is in the UK or The Channel Islands, the Agreement will be with Cineworld Cinemas Limited, a company registered in England and Wales under company number 01915767 with registered address at Power Road Studios, 114 Power Road, Chiswick, London W4 5PY, United Kingdom and VAT number 606197048.

4.3 If your residential address is in the Republic of Ireland, the Agreement will be with Adelphi Carlton Limited (trading as Cineworld Cinemas), a company registered in the Republic of Ireland under company number 7640 with registered address at 5th Floor, Block E, Iveagh Court, Harcourt Road, Dublin 2, Ireland and VAT number 8B41247E.

Cancellation Rights

5.1 Cineworld may cancel the Agreement in the circumstances referred to in clause 12.

5.2 You may cancel the Agreement at any time before the end of the period of seven working days starting on the Start Date if You applied for an Unlimited Card online and the temporary Unlimited Card has not been used during that period. (For the purpose of this clause 5, “working day” means Monday to Friday, excluding any public or bank holiday on which the banks in England and Wales are closed.) This cancellation right is not available if You have applied for an Unlimited Card in person using a paper application form at a Cineworld Cinema.

5.3 To cancel, You will need to contact the Unlimited Helpdesk by email, phone or in writing within the time period set out in clause 5.2.

5.4 You will receive a full refund of any subscription fee paid, less an administration fee of £5 (or €8 if You are in Ireland).

Unlimited Cards

6.1 There are three types of Unlimited Card:

(i) the Unlimited West End Card, which is valid in all Cineworld Cinemas including West End Cinemas;
(ii) the Unlimited Card, which is valid in all Cineworld cinemas excluding West End cinemas; and
(iii) the Republic of Ireland Unlimited Card, which is valid in all Cineworld Cinemas including West End Cinemas.

6.2 There are two tiers of each type of Unlimited Card referred to in clause 6.1:   

(i) new Users will be issued with a red standard Unlimited Card which entitles them to claim the benefits set out in clause 7.2 at the relevant Cineworld Cinemas.  This tier of card will entitle the User to claim certain specified additional discounts and offers available to red standard Unlimited Card holders as and when such offers and discounts are made available by Cineworld from time to time.
(ii) where a User has held a valid Unlimited Card for a continuous period of at least 12 months he/she will be issued with a black Premium Unlimited Card.  This tier of card will continue to entitle the User to claim the benefits set out in clause 7.2 at the relevant Cineworld Cinemas but will also entitle them to the additional discounts and offers which are made available only to black Premium Unlimited Card holders by Cineworld from time to time.

In order to claim the relevant additional discounts and offers referred to above, the User must show his/her valid red standard or black Premium Unlimited Card (as the case may be) at the appropriate Cineworld Cinema box office or Ticket and Concession Stand, or where the relevant discount or offer is available via the Cineworld website, by inputting the relevant details on the website as directed.  The additional discounts and offers made available for holders of red standard Unlimited Cards and black Premium Unlimited Cards are discretionary and may be withdrawn or amended at any time without notice.    

6.3 The number, location and opening hours of Cineworld Cinemas in any area may change during the Subscription Period. A list of current Cineworld Cinemas is available from www.cineworld.co.uk or www.cineworld.ie or on written request to the Unlimited Helpdesk enclosing a stamped self-addressed envelope.

6.4 If your application is accepted, Cineworld will issue the User with details of a temporary card either in a physical form (ie an email which can be printed off) or an SMS message containing the relevant details.  The User will be able to use their Unlimited Card membership by presenting these temporary card details at Cineworld Cinemas for up to 10 working days from date of issue or (if earlier) until the User receives his or her permanent card.

6.5 The permanent Unlimited Card will be valid from the Start Date, provided it displays a head and shoulders photograph which is a clear and true likeness of the User.  Inappropriate images may cause a delay in the processing of your application, for which Cineworld will not be responsible.

6.6 The Unlimited Card is not transferable or for sharing and only the User will be entitled to use it at the relevant Cineworld Cinemas.

Terms Of Use For Unlimited Cards

7.1 The User accepts these Conditions and Cineworld’s Terms of Entry by using an Unlimited Card.

7.2 A valid Unlimited Card entitles the User to:

(i) access to the relevant Cineworld Cinemas every day of the week (subject to the Cineworld Cinema being open);
(ii) one seat (subject to availability and excluding VIP, Delux and other special or premium seating) for any film screening open to the general public (excluding premium screenings such as 3-D screenings and alternative content screenings);
(iii) one seat (subject to availability and excluding VIP, Delux and other special or premium seating) for 3-D screenings at a significantly discounted rate; and
(iv) one seat (subject to availability and excluding VIP, Delux and other special or premium seating) at such discounted rates for alternative content screenings as may be available from time to time.

7.3 All film screenings are subject to normal restrictions such as age certifications, and Cineworld’s Terms of Entry. The User shall have no preferential rights of access for any screenings except for any special screenings organised for Unlimited Card users. The User is not entitled to use the Unlimited Card in conjunction with any other promotions offered by Cineworld unless otherwise stated and the Unlimited Card cannot be used to prove the User’s age.

7.4 The User may only book one ticket in advance in person at the Cineworld Cinema on the day of the performance.  Additionally, Users may be able to take advantage of Cineworld’s Unlimited Card online booking offer (where available) to use their Unlimited Card to book one ticket online via the User’s mycineworld account on Cineworld’s website.  The Unlimited Card online booking offer and all online ticket bookings made thereunder are subject to the Terms and Conditions for the Unlimited Card online ticket booking offer set out below at clause 18. Users may not book tickets by telephone.

7.5 To use the Unlimited Card, the User must present it at a Cineworld Cinema box office. The Unlimited Card will be scanned to check its validity and additional identification may be requested. If the Unlimited Card is validated, the User will be issued with a ticket for the chosen screening and time, subject to availability. If the Unlimited Card is not validated, the User may be advised to contact the Unlimited Helpdesk, for data protection reasons. The Unlimited Card must be shown again when the tickets are checked before entering the relevant auditorium. Entrance will not be permitted without the User presenting the Unlimited Card.  To use the Unlimited Card to book and/or collect a ticket booked online the User must follow the instructions set out on the Cineworld website and comply with the Terms and Conditions for the Unlimited Card online ticket booking offer set out below at clause 18.   

7.6 The Unlimited Card is only valid for one performance at any one time and, cannot be used to obtain a ticket for another performance before the film presentation for which it has been used comes to an end (although, the User can use his/her Unlimited Card to book one ticket online using the Unlimited Card online ticket booking offer (where available) see clause 18 below).

7.7 The Unlimited Card will be valid from the Start Date for the duration of the Initial Period unless terminated by You or Cineworld under clauses 5, 10, 11 or 12.

Payment Of Annual Subscription Fees

8.1 The annual subscription fee for the Initial Period and renewal fees for each type of Unlimited Card are available from Cineworld’s website, Cineworld Cinemas and the Unlimited Helpdesk. The annual subscription fee must be paid in advance under the Annual Payment Plan or, by installment under the Monthly Payment Plan, but in either case must be paid in full for the whole Initial Period.

8.2 Cineworld reserves the right to increase the annual subscription fee payable by installment under the Monthly Payment Plan to reflect the cost to Cineworld of accepting payment by installment. Such changes shall not take effect during the Initial Period and shall be notified to You in writing and at least one month before they come into effect.

8.3 Monthly Payment Plan
8.3.1 Under the Monthly Payment Plan, You agree to pay the full annual subscription fee for the Initial Period in 12 equal monthly installments during the Initial Period.
8.3.2 (a) When Cineworld accepts your application for an Unlimited Card, You shall pay the following amount by credit card, debit card, charge card, Cineworld e-gift voucher or Cineworld gift card (but not cash or cheque)]:
(i) if the User is a UK resident, the first month's installment; or
(ii) if the User is a resident in Ireland, the first two months’ installments.
(b) Each installment for the remaining months shall be paid in advance by Direct Debit from a nominated bank account. You will need to fill in the Direct Debit instruction included in the Agreement correctly prior to submitting your application form. Each payment will be debited on the same day of each month, being the same day of the month that the first installment was paid. If this date falls on a weekend or a bank holiday, or if there is no day of the same date in any month (e.g. 30 February) payment will be debited by your bank on the previous or next working day. Please check with your bank for details.

8.3.3 Unless You cancel your subscription at the end of the Initial Period in accordance with the Agreement, the Subscription Period will automatically be extended after the Initial Period if You continue to pay the monthly fee each month.

8.3.4 If You want to change the bank account to be debited, You must telephone the Unlimited Helpdesk to provide the new Direct Debit details and give Cineworld at least three weeks to process this change.

8.3.5 If, during the Initial Period, Cineworld does not receive any monthly payment or You seek to terminate the Agreement except as permitted in clauses 10 or 11, Cineworld may terminate the Agreement and deactivate the Unlimited Card as described in clause 12 below. Cineworld will be entitled to recover damages from You, which may include its reasonable administration expenses caused by the incident and the fees and expenses (including those of debt collectors) that Cineworld may reasonably and properly incur to recover the outstanding subscription fees which are due to Cineworld under the Agreement for the remainder of the Initial Period.

8.4 Annual Payment Plan

8.4.1 Under the Annual Payment Plan, You agree to pay the annual subscription fee for the Initial Period in a single advance payment.

8.4.2 You may pay the annual subscription fee by debit card, credit card or charge card,(but not cash or cheque).  Cineworld gift cards and e-gift vouchers may also be used to pay for annual subscription fees on the Cineworld website and at Unlimited terminals.    .

8.4.3 At least six weeks before the end of the Initial Period, Cineworld will offer You the opportunity to continue the subscription by paying the subscription fee for the next year by debit,  credit or charge card, or to move to the Monthly Payment Plan. In order to continue your subscription and/or move to the Monthly Payment Plan You will need to contact the Unlimited Helpdesk by telephone, as it is not possible to extend annual subscriptions or change payment plans via Cineworld’s website or Unlimited terminals and still receive the black Premium Unlimited Card.   The Unlimited Helpdesk is currently unable to accept payments by gift card or e-gift voucher, which means you can only pay for extension periods by debit, credit or charge card.

8.4.4 If this Agreement is terminated during the Initial Period (or any Subscription Period) on Legitimate Grounds (as described in clause 11), Cineworld will refund the amount paid in advance under the Annual Payment Plan for any full months remaining less one month.

8.5 Extending your Unlimited Card

8.5.1 If You extend the Subscription Period after the Initial Period, the fees for both the Monthly Payment Plan and the Annual Payment Plan will be those in force on the date the Initial Period expires.

8.5.2 Any extension of the Initial Period will be treated as part of the same Agreement as the Initial Period and You will not have any further cancellation rights under clause 5.1.

Lost, Stolen Or Defective Cards

9.1 The User will need to telephone the Unlimited Helpdesk as soon as possible to report any lost or stolen Unlimited Card.

9.2 If the Unlimited Card is lost or stolen, Cineworld will charge an administration fee to replace it. The charge is currently £10.00 (or €16.00 if You are in Ireland) but this may be changed by Cineworld to reflect its administration costs. Once the fee is paid, Cineworld will send a replacement card to the User.

9.3 If the subscription is paid by Direct Debit, the amount of the administration fee will be debited directly from your bank account. If a Direct Debit is not in place, You will need to pay the administration fee before Cineworld will send out a new card.

9.4 If the card is defective, the User must return it to the Unlimited Helpdesk as soon as possible for a free replacement. Cineworld’s liability in such cases is expressly limited to replacement of the defective Unlimited Card.

9.5 For the avoidance of doubt, no refunds will be given for cinema tickets purchased by the User between the date the card was lost or stolen or a replacement card was requested and the date the User receives his or her new card. Users will not be entitled to an Unlimited ticket until the replacement card has been received and is presented as necessary at a Cineworld Cinema to obtain or collect tickets and to gain entry to the auditorium.  A User will be unable to take advantage of the Unlimited online ticket booking offer (where available) until he/she receives a replacement card and updates his/her details in his/her mycineworld account.

Changes

10.1 Subscription fees may be increased by Cineworld to reflect changes in standard ticket prices, inflation, Cineworld’s costs, additional taxes and costs that are not imposed by Cineworld. Any increase in the subscription fee will be notified to You at least one month before it comes into effect. Increases shall not take effect during any Initial Period, except as described in clause 10.2.

10.2 If there is a change in the rate of VAT or any other tax, or any other tax is imposed, Cineworld will be entitled to change the subscription fees to reflect such changes, at any time including during the Initial Period. This change will only affect You during the Initial Period if You are on the Monthly Payment Plan. Cineworld will give not less than one month’s notice of any increase and the Direct Debit amounts after expiry of such notice will be adjusted accordingly. Any other changes shall take effect as described in the remainder of this clause 10.

10.3 If You have extended the Subscription Period beyond any Initial Period increases in the subscription fees will take effect after expiry of any notice given by Cineworld under clause 10.1 or 10.2 as follows:
(i) if You pay the fees under the Monthly Payment Plan, the Direct Debit amounts after expiry of the notice will be adjusted accordingly;
(ii) if You pay the fees in advance, the increase will take effect at the end of the period for which fees have been paid.

10.4 Changes to these Conditions:

10.4.1 Cineworld may make minor changes to these Conditions from time to time to correct errors or to clarify the terms.  You will not be specifically notified of such changes but they will be on Cineworld’s website and so to see the most up to date version of these conditions please always check the Cineworld website.  No such changes shall disadvantage You or a User.
10.4.2 Additionally, Cineworld reserves the right to make other changes to the Conditions on giving You at least one month’s prior written notice.  Any such notification of a change shall be made by contacting you using the details you have provided as referred to in clause 17 (Contact Details)

10.5 If:

(i) You are on the Monthly Payment Plan and these changes either increase the monthly installment payable or are otherwise to your disadvantage during the Initial Period, or
(ii) You are on the Annual Payment Plan and the changes are to your disadvantage,

You will have 30 days from the notice date in which to terminate the Agreement.

10.6 If You terminate the Agreement under clause 10.5 and You are on the Monthly Payment Plan, You may stop making payments from one month after the date of the direct debit which follows You telling us you wish to terminate. If You are on the Annual Payment Plan, Cineworld will repay You an amount equal to the value of the remaining full months' subscription fee less one month.

Termination By You

11.1 You may terminate the Agreement during the Initial Period only on Legitimate Grounds. You must notify Cineworld in writing of your request to terminate, stating the reason for termination and enclosing any supporting evidence. The application must be made by phone or in writing by post or email to the Unlimited Helpdesk.

11.2 If Cineworld accepts that the User has Legitimate Grounds and You are on the Monthly Payment Plan, the Agreement will terminate one month after the date of the Direct Debit which follows receipt of the application referred to in clause 11.1 by the Unlimited Helpdesk. If you are on the Annual Payment Plan, Cineworld will repay You an amount equal to the value of the remaining full months' subscription fee less one month.

11.3 If Cineworld does not accept the request for termination, the Agreement shall continue in force. If You are on the Monthly Payment Plan, You must continue to pay the subscription fee for the remainder of the Initial Period. If You are on the Annual Payment Plan, You will not be entitled to any refund of the subscription fee.

11.4 In the event of termination on Legitimate Grounds, neither You nor the User may re-subscribe for an Unlimited Card until 6 months after the termination date.

11.5 If You are on a Monthly Payment Plan, You may terminate the Agreement at any time after the Initial Period by giving one full month’s notice. Notice must be given to the Unlimited Helpdesk by phone or in writing by email or post. Termination will take effect one month after the date of the Direct Debit which follows receipt of Your notice to terminate. PLEASE NOTE: due to Cineworld’s current payment processes, if You are paying by Direct Debit, any Unlimited Card will be automatically deactivated if You cancel the Direct Debit. If You wish to cancel your Direct Debit, please do not do so until after the date on which your Unlimited Card expires or terminates. Cineworld will confirm this date in writing on receipt of your termination notice.

11.6 If You have extended the Subscription Period for a full year after the Initial Period and have paid under the Annual Payment Plan, You may cancel the Unlimited Card on one months’ notice and Cineworld will refund the fees paid for any remaining full months after the termination date. You may cancel by contacting the Unlimited Helpdesk by phone or in writing by email or post.

11.7 Additionally, You may terminate the Agreement at any time if Cineworld commits a serious breach of the Agreement.

11.8 On termination, the Unlimited Card will be de-activated and, if payment is made by Direct Debit, the debits will be stopped and any refunds due will be paid.

Suspension And Termination By Us

12.1 Cineworld may suspend the Agreement and temporarily deactivate the Unlimited Card if:

(i) You miss any payment. Cineworld will contact You by email or letter and if payment is made on request, Cineworld will normally reactivate the Unlimited Card within 48 hours of payment. Users will not be entitled to an Unlimited ticket until the Unlimited Card has been reactivated and, for the avoidance of doubt, no refunds will be given for cinema tickets purchased by the User between the date the Unlimited Card is deactivated until the date it is reactivated;
(ii) Cineworld suspects any fraud in any matter connected to entering into or performing the Agreement including providing false information on the application form; or
(iii) the User breaches any of Cineworld’s Terms of Entry.


12.2 Cineworld may terminate the Agreement immediately on any of the following grounds:

(i) for your fraud (or our reasonable suspicion of your fraud) in any matter connected to entering into or performing the Agreement including providing any false information on the application form;
(ii) in the event of fraudulent or significant misuse of the Unlimited Card;
(iii) if You miss a payment and fail to make that payment within 28 days of a request from Cineworld to make it, or if You miss more than one payment;
(iv) material breach of the Agreement by You or the User that has not been corrected by You within a reasonable time;
(v) if You or a User engages in any behaviour or activity that is disruptive to or damaging to any   Cineworld business or operation, process or practice.


12.3 If Cineworld terminates the Agreement under this clause 12, Cineworld may keep any subscription payments that have been received. Where You are on the Annual Payment Plan, Cineworld may refund any subscription fees paid for any full months after the termination date but shall be entitled to retain a fair amount to reflect the loss to Cineworld from terminating the Agreement in such circumstances. This right does not limit any other rights Cineworld may have against You.

12.4 On termination, Cineworld will deactivate the Unlimited Card.

12.5 Cineworld reserves the right to terminate, withdraw or suspend the Unlimited Card subscription arrangements, and the Agreement, at any time for any reason on reasonable notice in writing to You. Cineworld will refund the fees paid by You in advance for any remaining full months after the termination date.

Questions And Complaints

Any questions or complaints You may have in relation to the Unlimited Card or a notification of change in your circumstances should be directed to the Unlimited Helpdesk.

Information Provided

You confirm that the information You provide about You and the User (including contact information) (Personal Information) is accurate and complete and that You are authorised to provide such Personal Information. It is your responsibility to ensure that such Personal Information is kept up to date, and Cineworld will not be responsible for errors or omissions in your Personal Information at any time. You may update your details at any time by contacting the Unlimited Helpdesk. The terms of the Privacy Policy apply to our use of Personal Information. In addition, You authorise Cineworld to (i) transfer or disclose Personal Information to professional advisers and such other parties as is necessary for the administration of Cineworld’s business (including financial decisions), customer profile research or if required to disclose such information required by law; and (ii) use any Personal Information to provide You and the User with information about your membership account, offers, products and/or services offered by Cineworld from time to time. You and the User may choose to opt-out of being contacted by Cineworld by ticking the opt-out box on the application form or notifying the Unlimited Helpdesk at any time during the Agreement.

Cineworld's Liability

15.1 Cineworld Cinemas may be closed on a permanent or temporary basis from time to time, including for refurbishment or due to a Force Majeure Event (as described below). Details of such closures can be found on Cineworld’s website or by calling the Unlimited Helpdesk.

15.2 Cineworld will not be liable or responsible for any failure to perform, or delay in performance, that is caused by events outside its reasonable control (Force Majeure Event), including any act, event, non-happening, omission or accident which may be due to the following:

(i) Strikes, lock-outs or other industrial action;
(ii) Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war or threat or preparation for war;
(iii) Fire, explosion, adverse weather, snow fall, ice, storm, flood, earthquake, subsidence, epidemic or other natural disaster;
(iv) Disruption to or failure of the railways, shipping, aircraft, motor transport or other means of public or private transport;
(v) Disruption to or failure of public or private telecommunications networks, utility supplies or postal services;
(vi) Closure or limited access to Cineworld Cinemas on the grounds of Cineworld’s reasonable health and safety concerns;
(vii) Any governmental act, decree, legislation, regulation or restriction.


15.3 Cineworld’s liability for faulty Unlimited Cards is limited to the remedies described in clause 9.

15.4 Cineworld’s liability for its breach of the Agreement is limited to the annual subscription fee.

15.5 Cineworld will not in any event be liable for: (a) any loss of profit, revenue, business, contract, goodwill, or other financial or economic loss or damage; or (b) any indirect loss or damage which is not reasonably foreseeable as likely to occur in the ordinary course of events.

15.6 Cineworld does not exclude or restrict its liability for fraud, for death or personal injury resulting from its negligence or that of its agents or for any other liability that it cannot restrict or exclude by law, and nothing in this clause 15 shall operate to exclude, restrict or limit this liability.

16.1 The Agreement and any disputes or claims arising out of or in connection with it (including non-contractual disputes or claims) are governed by the laws of England and Wales and are subject to the non-exclusive jurisdiction of the courts of England and Wales, unless You live in Scotland, Northern Ireland, the Republic of Ireland or The Channel Islands in which case the relevant law will apply and You can choose to take action against Cineworld in your local courts.

16.2 Cineworld does not accept amendments by You to the Conditions.

16.3 You and the User may not transfer any of your rights or obligations under the Agreement to another person without Cineworld’s prior written consent. Cineworld can transfer all or any part of its rights or obligations under the Agreement to another organisation but your and the User’s rights under the Agreement will not be affected.

16.4 If the Agreement is terminated by either party for any reason, neither party will lose any rights which have already accrued.

16.5 If, at any time, Cineworld does not require You to comply with any part of the Agreement, this will not prevent it from doing so in the future.

16.6 If any part of the Agreement is disallowed or held to be ineffective by any court or other competent body, the rest of the Agreement will not be affected.

17.2 If Cineworld need to contact You or Users about the Agreement or the Unlimited Card (for example to notify You of changes to these Conditions or to terminate the Agreement) we may do so by any reasonable method including by sending notices and other communications to the postal or email address provided on Your application for the Unlimited Card (or where You have advised the Unlimited Helpdesk of a change of address we will use the latest details that you have provided).  It is therefore important that you keep your contact details updated.  Where we do contact you by email we will be deemed to have notified You or a User as soon as the email is delivered for instance into your inbox or onto the relevant server, provided that we do not receive a “bounce back” notification from that email address.  Where we contact you by post we will be deemed to have served notice on You or the User two working days after the date of posting provided that the notice has not been returned to sender within 28 days of posting.

Terms and Conditions for the Unlimited card online ticket booking offer

18.1 The following terms apply to ticket bookings made through the Web Site using an Unlimited Card.

18.2 Tickets booked online using an Unlimited Card may only be booked through a mycineworld account. All online ticket bookings are subject to the Cineworld Website Terms of Use. The Cineworld Online Ticket Purchases Terms will apply to bookings for tickets using an Unlimited Card as if payment for the ticket had been made using a debit, credit or charge card except as set out in this clause. Use of the Unlimited Card will remain subject to these Conditions.

18.3 Only one ticket per Unlimited Card may be booked online at any time and no further online ticket booking may be made using that Unlimited Card until the screening to which the existing booking relates has come to an end.

18.4 mycineworld discounts will not apply to (i) any uplift payment for tickets for 3-D screenings booked online using an Unlimited Card or (ii) tickets for alternative content screenings booked online using an Unlimited Card, although the usual Unlimited discounts for these types of screenings will continue to apply in accordance with clause 7.2 of the Unlimited Terms and Conditions.

18.5 Tickets for other customers may be booked for the same screening as part of the same transaction at standard prices for the relevant performance (less the mycineworld discount being offered at the time of booking (if any)). You may also include ticket bookings for the same screening for other Unlimited customers as part of your booking, but please ensure that you have obtained their permission in advance.

18.6 Payments for additional tickets and any surcharges must be paid for online using a valid debit/credit/charge card or Cineworld Gift Card or e-Gift Card (where available).

18.7 Pre-booked tickets can be collected at the relevant Cineworld Cinema Box Office, Ticket and Concession Stand or automatic ticket machines (booking reference required for collection from ATM) on the day of screening with the exception of tickets for alternative content or Unlimited exclusive screenings which may be collected at any time after the date of booking.

18.8 Tickets will only be issued on production of (i) the Unlimited Card used to make the booking, (ii) the relevant booking reference or (iii) where a payment has been made as part of the booking transaction, the debit/credit/charge card used to make the payment. E-ticketing is currently not available for tickets booked online using an Unlimited Card.

18.9 Each Unlimited customer for whom a ticket has been booked must show their Unlimited Card when the tickets are checked before entering the relevant auditorium.

18.10 Any ticket booked online using an Unlimited Card must be collected no later than 20 minutes before the advertised screening time on the day of performance otherwise Cineworld may release it for general sale. No refunds will be given.

18.11 Cineworld may (i) discontinue or change the Unlimited Card online booking function at any time without notice and/or (ii) amend the terms and conditions of the Unlimited Card online booking offer from time to time without notice.

Terms of current Unlimited offers and discounts

19.1 Unlimited offers and discounts are only available on production of a valid Unlimited Card. 

19.2  IMAX, D-Box and Alternative Content uplifts are still payable.  3D uplifts are currently not payable by Premium Unlimited customers but will remain payable by all other Unlimited customers.  Charges apply for 3D glasses and VIP/Delux seating as they are not included as part of Unlimited membership. 

19.3 Discounts on food and drink available only when purchased in-cinema and do not apply to any items purchased online. Maximum discount of 10% on Starbucks products.
Discounts may not be available in conjunction with some offers and promotions.

19.4 All offers and discounts are valid until further notice and may be withdrawn at any time.

19.5 Terms and Conditions for the 13 for 12 offer:
Offer is for 13 months’ Unlimited membership for the price of 12 months (the 13th month is free). Offer only valid for sign-ups using the promotional code provided between 1st of January and 2nd February 2014 inclusive (or earlier date as advised by your third party provider). Existing Unlimited members or those who have enjoyed an Unlimited membership in the last 6 months are not eligible. Standard Unlimited card terms and conditions apply.


Unlimited Terms And Conditions - Only applicable to members who signed up before 15th March 2013 and are still within their initial/annual 12 month membership period

Introduction

1.1    The Conditions and the Privacy Policy apply to all Unlimited Cards. You will be required to confirm that You agree to be bound by the Conditions during the purchase process.  Please read them carefully and make sure that You understand them before You sign up.  They do not affect your legal rights. 

1.2    Cineworld may change the Conditions at any time as described in clause 10 below.

1.3    The Conditions were last updated on 15 April 2011.  We recommend that You print and keep a copy of these Conditions for future reference if You have applied for an Unlimited Card on Cineworld’s website. 

Definitions

2.1    In the Conditions, the following words have the meanings set out against them:
Agreement: the agreement between You and Cineworld for the purchase and use of an Unlimited Card;

Cineworld: the company identified in either clause 4.2 or 4.3, as the case may be;

Cineworld Cinemas: all Cineworld cinemas owned and operated by Cineworld in the Territory, including the West End Cinemas;

Cineworld’s General Terms and Conditions: the general terms and conditions set out in Cineworld’s Entry Policy applying to customers' attendance at Cineworld’s Cinemas, as available from Cineworld Cinemas, the Unlimited Helpdesk or online at www.cineworld.com;

Conditions: these written terms and conditions;

Initial Period: a period of 12 months from the Start Date;

Legitimate Grounds: where the User is unable to use his or her Unlimited Card for a continuing period of two calendar months due to medical reasons or because the User’s permanent address moves to an address outside the Territory;

Privacy Policy: Cineworld’s privacy policy set out at www.cineworld.com/policy and which is also available from Cineworld Cinemas or the Unlimited Helpdesk;

Start Date: the date on which a temporary Unlimited Card is issued by  Cineworld;

Subscription Period: the Initial Period and any extended period (whether for a month or a year) for which an Unlimited Card is purchased;

Territory: the United Kingdom, the Channel Islands and the Republic of Ireland;

Unlimited Card: one of the cards described in clause 6.1 giving the User access to Cineworld Cinemas in the Territory during the Subscription Period, subject to the Conditions;

Unlimited Helpdesk: the Unlimited Subscription Department Helpdesk whose contact details are: 0844 372 3445 (or 0818 304 204 if calling from Ireland), Unlimited Helpdesk, Cineworld Cinemas Limited, PO Box 6138, Wolverhampton WV1 9RP, UK and contactus@unlimitedcineworld.com;

User: the person named as such on the Unlimited Card;

West End Cinemas: the Cineworld West End cinemas which are currently Cineworld Chelsea, Cineworld Haymarket, Cineworld Fulham Road and Cineworld Shaftesbury Avenue. Details of any changes will be available from Cineworld Cinemas or by phoning the Unlimited Helpdesk;

You: the person who enters into an Agreement for the purchase of an Unlimited Card.

Application Process

3.1    You may apply for any number of Unlimited Cards for You or any other Users by completing the application form on Cineworld’s website or by submitting an application form at any Cineworld Cinema box office.

3.2    Cineworld will process your application(s) and will confirm whether or not your application(s) is/are accepted through its website or at the relevant Cineworld Cinema box office.  Alternatively, Cineworld may decline all or part of your application for any reason, in which case Cineworld will notify You as soon as practicable.

3.3    The creation of an Agreement between You and Cineworld will only occur when Cineworld confirms acceptance of your application and issues details of the User’s temporary Unlimited Card (as per clause 6).  If You have applied online and your application(s) is/are accepted, Cineworld will send You an email with details of the temporary Unlimited Card.  You will need a printer in order to print off your temporary Unlimited Card.

3.4    When deciding whether or not to accept your application Cineworld may use certain information about You, including any received from credit reference agency checks. In particular, Cineworld may pass your details to credit reference agencies for them to check against certain public and private databases. Credit reference agencies may keep a record to use in future security checks. This helps to protect You and us against fraudulent transactions.

3.5    By applying for Unlimited Card(s), You confirm:
(i)    You are legally capable of entering into a binding contract;
(ii)    You are at least 18 years old; and
(iii)    the User is resident in the UK or Ireland.

3.6    You understand that by purchasing an Unlimited Card, You are committing to pay the full annual subscription fee for the Initial Period of 12 months.  Payment of the full annual subscription fee may be made under Cineworld’s Monthly Payment Plan or Cineworld’s  Annual Payment Plan.  (See clause 8 below.)

3.7    If You pay in accordance with the Annual Payment Plan, no refund of the annual subscription fee for the Initial Period which is paid in advance will be made unless You cancel the subscription under clauses 5 (Cancellation Rights), 10 (Changes), or 11 (Legitimate Grounds).   

3.8    If You pay in accordance with the Monthly Payment Plan, You will have to pay all instalments of the annual subscription fee unless You cancel under clauses 5 (Cancellation Rights), 10 (Changes), or 11 (Legitimate Grounds).  Failure to pay in accordance with the Monthly Payment Plan could result in your account being passed to debt collection.

3.9    Cineworld reserves the right to withdraw the paper based application process at any time without notice.

Agreement

4.1    The Agreement shall include your application form, the Conditions, Cineworld’s General Terms and Conditions and the Privacy Policy. No other terms shall apply.

4.2    If your residential address is in the UK, the Agreement will be with Cineworld Cinemas Limited, a company registered in England and Wales under company number 01915767 with registered address at Power Road Studios, 114 Power Road, Chiswick, London W4 5PY, United Kingdom and VAT number 606197048.

4.3    If your residential address is in the Republic of Ireland, the Agreement will be with Adelphi Carlton Limited (trading as Cineworld Cinemas), a company registered in the Republic of Ireland under company number 7640 with registered address at 5th Floor, Block E, Iveagh Court, Harcourt Road, Dublin 2, Ireland  and VAT number 8B41247E.

Cancellation Rights

5.1    Cineworld may cancel the Agreement in the circumstances referred to in clause 12.

5.2    You may cancel the Agreement at any time before the end of the period of seven working days starting on the Start Date if You applied for an Unlimited Card online and the temporary Unlimited Card has not been used during that period.  (For the purpose of this clause 5, “working day” means Monday to Friday, excluding any public or bank holiday on which the banks in England and Wales are closed.)  This cancellation right is not available if You have applied for an Unlimited Card in person using a paper application form at a Cineworld Cinema.

5.3    To cancel, You will need to contact the Unlimited Helpdesk by email, phone or in writing within the time period set out in clause 5.2.

5.4    You will receive a full refund of any subscription fee paid, less an administration fee of £5 (or €8 if You are in Ireland).

Unlimited Cards

6.1    There are three types of Unlimited Card:
    (i) the Unlimited West End Card, which is valid in all Cineworld Cinemas including West End Cinemas;
    (ii) the Unlimited Card, which is valid in all Cineworld cinemas excluding West End cinemas; and
    (iii) the Republic of Ireland Unlimited Card, which is valid in all Cineworld Cinemas including West End Cinemas.

6.2    The number, location and opening hours of Cineworld Cinemas in any area may change during the Subscription Period.  A list of current Cineworld cinemas is available from www.cineworld.co.uk or www.cineworld.ie or on written request to the Unlimited Helpdesk enclosing a stamped self-addressed envelope.

6.3    If your application is accepted, Cineworld will issue the User with a temporary card which will be valid for 28 days until the User receives his or her permanent card.

6.4    The permanent Unlimited Card will be valid from the Start Date, provided:
(i)    it displays a head and shoulders photograph which is a clear and true likeness of the User; and
(ii)    is signed by the User on the signature strip.
Inappropriate images may cause a delay in the processing of your application, for which Cineworld will not be responsible.

6.5    The Unlimited Card is not transferable and only the User will be entitled to use it at the relevant Cineworld Cinemas.

Terms Of Use For Unlimited Cards

7.1    The User accepts the Conditions and Cineworld’s General Terms and Conditions by using an Unlimited Card. 

7.2    A valid Unlimited Card entitles the User to:
(i)    access to the relevant Cineworld Cinemas every day of the week (subject to the Cineworld Cinema being open);
(ii)    one seat (subject to availability and excluding VIP, Delux and other special or premium seating) for any film screening open to the general public (excluding premium screenings such as 3-D screenings);
(iii)    one seat (subject to availability and excluding VIP, Delux and other special or premium seating) for 3-D screenings at a significantly discounted rate;  and
(iv)    one seat (subject to availability and excluding VIP, Delux and other special or premium seating) at such discounted rates for alternative content screenings as may be available from time to time.

7.3    All film screenings are subject to normal restrictions such as age certifications, and Cineworld’s General Terms and Conditions.  The User shall have no preferential rights of access for any screenings except for special screenings organised for Unlimited Card users.  The User is not entitled to use the Unlimited Card in conjunction with any other promotions offered by Cineworld unless otherwise stated and the Unlimited Card cannot be used to prove the User’s age.

7.4    The User may only book a ticket in advance in person at the Cineworld Cinema on the day of the performance and may not book online or by telephone.

7.5    To use the Unlimited Card, the User must present it at a Cineworld Cinema box office. The Unlimited Card will be scanned to check its validity and additional identification may be requested.  If the Unlimited Card is validated, the User will be issued with a ticket for the chosen screening and time, subject to availability.  If the Unlimited Card is not validated, the User may be advised to contact the Unlimited Helpdesk, for data protection reasons.  The Unlimited Card must be shown again when the tickets are checked before entering the relevant auditorium.  Entrance will not be permitted without the User presenting the Unlimited Card.

7.6    The Unlimited Card is only valid for one performance at any one time and cannot be used to obtain a ticket for another performance before the film presentation for which it has been used comes to an end.

7.7    The Unlimited Card will be valid from the Start Date for the Initial Period unless terminated by You or Cineworld under clauses 5.2, 10, 11 or 12.

Payment Of Annual Subscription Fees

8.1    The annual subscription fee for the Initial Period and renewal fees for each type of Unlimited Card are available from Cineworld’s website, Cineworld Cinemas and the Unlimited Helpdesk.  The annual subscription fee must be paid in advance under the Annual Payment Plan or, by instalment under the Monthly Payment Plan, but in either case must be paid in full for the whole Initial Period.

8.2    Cineworld reserves the right to increase the annual subscription fee payable by instalment under the Monthly Payment Plan to reflect the cost to Cineworld of accepting payment by instalment.   Such changes shall not take effect during the Initial Period and shall be notified to You in writing and at least one month before they come into effect.

8.3    Monthly Payment Plan
    8.3.1    Under the Monthly Payment Plan, You agree to pay the full annual subscription fee for the Initial Period in 12 equal monthly instalments during the Initial Period.
8.3.2    (a) When Cineworld accepts your application for an Unlimited Card, You shall pay the following amount by credit card, debit card, Cineworld voucher, gift card or cash (vouchers, gift cards and cash may only be used at Cineworld Cinema box offices and only if the application is being made in paper form):
(i)     if the User is a UK resident, the first month's instalment; or
(ii)     if the User is a resident in Ireland, the first two months’ instalments.
(b) Each instalment for the remaining months shall be paid in advance by Direct Debit from a nominated bank account.  You will need to fill in the Direct Debit instruction included in the Agreement correctly prior to submitting your application form. Each payment will be debited on the same day of each month, being the same day of the month that the first instalment was paid.  If this date falls on a weekend or a bank holiday, or if there is no day of the same date in any month (e.g. 30 February) payment will be debited by your bank on the previous or next working day.  Please check with your bank for details.

8.3.3    Unless You cancel your subscription at the end of the Initial Period in accordance with the Agreement, the Subscription Period will automatically be extended after the Initial Period if You continue to pay the monthly fee each month.

8.3.4    If You want to change the bank account to be debited, You must telephone the Unlimited Helpline to provide the new Direct Debit details and give Cineworld at least three weeks to process this change. 

8.3.5    If, during the Initial Period, Cineworld does not receive any monthly payment or You seek to terminate the Agreement except as permitted in clauses 10 or 11, Cineworld may terminate the Agreement and deactivate the Unlimited Card as described in clause 12 below. Cineworld will be entitled to recover damages from You, which may include its reasonable administration expenses caused by the incident and the fees and expenses (including those of debt collectors) that Cineworld may reasonably and properly incur to recover the outstanding subscription fees which are due to Cineworld under the Agreement for the remainder of the Initial Period.

8.4    Annual Payment Plan

8.4.1    Under the Annual Payment Plan, You agree to pay the annual subscription fee for the Initial Period in a single advance payment.

8.4.2    You may pay the annual subscription fee by debit card, credit card, Cineworld voucher, gift card or cash (vouchers, gift cards and cash may only be used at Cineworld Cinema box offices and only if the application is being made in paper form).

8.4.3    At least six weeks before the end of the Initial Period, Cineworld will offer You the opportunity to pay the subscription fee for the next year by debit or credit card, or to move to the Monthly Payment Plan.

8.4.4    If this Agreement is terminated during the Initial Period (or any Subscription Period) on Legitimate Grounds (as described in clause 11), Cineworld will refund the amount paid for any full months remaining less one month.

8.5    Extending your Unlimited Card   

8.5.1    If You extend the Subscription Period after the Initial Period, the fees for both the Monthly Payment Plan and the Annual Payment Plan will be those in force on the date the Initial Period expires.

Lost, Stolen Or Defective Cards

9.1    The User will need to telephone the Unlimited Helpdesk as soon as possible to report any lost or stolen Unlimited Card. 

9.2    If the Unlimited Card is lost or stolen, Cineworld will charge an administration fee to replace it.  The charge is currently £10.00 (or €16.00 if You are in Ireland) but this may be changed by Cineworld to reflect its administration costs.  Once the fee is paid, Cineworld will send a replacement card to the User.

9.3    If the subscription is paid by Direct Debit, the amount of the administration fee will be debited directly from your bank account. If a Direct Debit is not in place, You will need to pay the administration fee before Cineworld will send out a new card.

9.4    If the card is defective, the User must return it to Unlimited Helpdesk as soon as possible for a free replacement.  Cineworld’s liability in such cases is expressly limited to replacement of the defective Unlimited Card.

9.5    For the avoidance of doubt, no refunds will be given for cinema tickets purchased by the User between the date the card was lost or stolen or a replacement card was requested and the date the User receives his or her new card.  Users will not be entitled to an Unlimited ticket until the replacement card has been received and is presented to the Cineworld Cinema box office in accordance with clause 7.5.

Changes

10.1     Subscription fees may be increased by Cineworld to reflect changes in standard ticket prices, inflation, Cineworld’s costs, additional taxes and costs that are not imposed by Cineworld. Any increase in the subscription fee will be notified to You at least one month before it comes into effect.  Increases shall not take effect during any Initial Period, except as described in clause 10.2.

10.2    If there is a change in the rate of VAT or any other tax, or any other tax is imposed, Cineworld will be entitled to change the subscription fees to reflect such changes, at any time including during the Initial Period.  This change will only affect You during the Initial Period if You are on the Monthly Payment Plan. Cineworld will give not less than one month’s notice of any increase and the Direct Debit amounts after expiry of such notice will be adjusted accordingly.  Any other changes shall take effect as described in the remainder of this clause 10.

10.3    If You have extended the Subscription Period beyond any Initial Period increases in the subscription fees will take effect after expiry of any notice given by Cineworld under clause 10.1 or 10.2 as follows:
 (i)    if You pay the fees under the Monthly Payment Plan, the Direct Debit amounts after expiry of the notice will be adjusted accordingly;
(ii)    if You pay the fees in advance, the increase will take effect at the end of the period for which fees have been paid. 

10.4    Cineworld reserves the right to make changes to the Conditions on giving You at least one month’s prior written notice.

10.5    If:
(i)    You are on the Monthly Payment Plan and these changes either increase the monthly instalment payable or are otherwise to your disadvantage during the Initial Period, or
(ii)    You are on the Annual Payment Plan and the changes are to your disadvantage,
You will have 30 days from the notice date in which to terminate the Agreement. 

10.6    If You terminate the Agreement under clause 10.5 and You are on the Monthly Payment Plan, You may stop making payments from one month after the date of the direct debit which follows You telling us you wish to terminate.  If You are on the Annual Payment Plan, Cineworld will repay You an amount equal to the value of the remaining full months' subscription fee less one month.

Termination By You

11.1    You may terminate the Agreement during the Initial Period only on Legitimate Grounds.  You must notify Cineworld in writing of your request to terminate, stating the reason for termination and enclosing any supporting evidence. The application must be made by post or via email to the Unlimited Helpdesk.

11.2    If Cineworld accepts that the User has Legitimate Grounds and You are on the Monthly Payment Plan, the Agreement will terminate one month after the date of the Direct Debit which follows receipt of the application referred to in clause 11.1 by the Unlimited Helpdesk.  If you are on the Annual Payment Plan, Cineworld will repay You an amount equal to the value of the remaining full months' subscription fee less one month.

11.3    If Cineworld does not accept the request for termination, the Agreement shall continue in force. If You are on the Monthly Payment Plan, You must continue to pay the subscription fee for the remainder of the Initial Period.  If You are on the Annual Payment Plan, You will not be entitled to any refund of the subscription fee. 

11.4    In the event of termination on Legitimate Grounds, neither You nor the User may re-subscribe for an Unlimited Card until 6 months after the termination date.

11.5    If You are on a Monthly Payment Plan, You may terminate the Agreement at any time after the Initial Period by giving one full month’s notice.  Notice must be given to the Unlimited Helpdesk in writing by post or via email.  Termination will take effect one month after the date of the Direct Debit which follows receipt of Your notice to terminate.   PLEASE NOTE:  due to Cineworld’s current payment processes, if You are paying by Direct Debit, any Unlimited Card will be automatically deactivated if You cancel the Direct Debit.   If You wish to cancel your Direct Debit, please do not do so until after the date on which your Unlimited Card expires or terminates.   Cineworld will confirm this date in writing on receipt of your termination notice.

11.6    If You have extended the Subscription Period for a full year after the Initial Period and have paid under the Annual Payment Plan, You may cancel the Unlimited Card on one months’ notice and Cineworld will refund the fees paid for any remaining full months after the termination date.   You may cancel by contacting the Unlimited Helpdesk by email, phone or in writing.

11.7    Additionally, You may terminate the Agreement at any time if Cineworld commits a serious breach of the Agreement.

11.8    On termination, the Unlimited Card will be de-activated and, if payment is made by Direct Debit, the debits will be stopped and any refunds due will be paid.

Suspension And Termination By Us

12.1    Cineworld may suspend the Agreement and temporarily deactivate the Unlimited Card if:
(i)    You miss any payment.  Cineworld will contact You by email or letter and if payment is made on request, Cineworld will reactivate the Unlimited Card within 48 hours of payment.  Users will not be entitled to an Unlimited ticket until the Unlimited Card has been reactivated and, for the avoidance of doubt, no refunds will be given for cinema tickets purchased by the User between the date the Unlimited Card is deactivated until the date it is reactivated;
(ii)    Cineworld suspects any fraud in any matter connected to entering into or performing the Agreement including providing false information on the application form;  or
(iii)    the User breaches any of Cineworld’s General Terms and Conditions.

12.2    Cineworld may terminate the Agreement immediately on any one of the following grounds:
(i)    for your fraud (or our reasonable suspicion of your fraud) in any matter connected to entering into or performing the Agreement including providing  any false information on the application form;
(ii)    in the event of fraudulent or persistent or serious misuse of the Unlimited Card;
(iii)    if You miss a payment and fail to make that payment within 28 days of a request from Cineworld to make it, or if You miss more than one payment;
(iv)    material breach of the Agreement by You or the User that has not been corrected by You within a reasonable time.

12.3    If Cineworld terminates the Agreement under this clause 12, Cineworld may keep any subscription payments that have been received.   Where You are on the Annual Payment Plan, Cineworld may refund any subscription fees paid for any full months after the termination date but shall be entitled to retain a fair amount to reflect the loss to Cineworld from terminating the Agreement in such circumstances.   This right does not limit any other rights Cineworld may have against You.

12.4    On termination, Cineworld will deactivate the Unlimited Card.

12.5    Cineworld reserves the right to terminate, withdraw or suspend the Unlimited Card subscription arrangements, and the Agreement, at any time for any reason on reasonable notice in writing to You.  Cineworld will refund the fees paid by You in advance for any remaining full months after the termination date.

Questions And Complaints

Any questions or complaints You may have in relation to the Unlimited Card or a notification of change in your circumstances should be directed to the Unlimited Helpdesk.

Information Provided

You confirm that the information You provide about You and the User (including contact information) (Personal Information) is accurate and complete and that You are authorised to provide such Personal Information. It is your responsibility to ensure that such Personal Information is kept up to date, and Cineworld will not be responsible for errors or omissions in your Personal Information at any time.  You may update your details at any time by contacting the Unlimited Helpdesk. The terms of the Privacy Policy apply to our use of Personal Information.  In addition, You authorise Cineworld to (i) transfer or disclose Personal Information to professional advisers and such other parties as is necessary for the administration of Cineworld’s business (including financial decisions), customer profile research or if required to disclose such information required by law; and (ii) use any Personal Information to provide You and the User with information about your membership account, offers, products and/or services offered by Cineworld from time to time.  You and the User may choose to opt-out of being contacted by Cineworld by ticking the opt-out box on the application form or notifying the Unlimited Helpdesk at any time during the Agreement.

Cineworld's Liability

15.1    Cineworld Cinemas may be closed on a permanent or temporary basis from time to time, including for refurbishment or due to a Force Majeure Event (as described below).  Details of such closures can be found on Cineworld’s  website or by calling the Unlimited Helpdesk.  

15.2    Cineworld will not be liable or responsible for any failure to perform, or delay in performance, that is caused by events outside its reasonable control (Force Majeure Event), including any act, event, non-happening, omission or accident which may be due to the following:
(i)    Strikes, lock-outs or other industrial action;
(ii)    Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war or threat or preparation for war;
(iii)    Fire, explosion, adverse weather, snow fall, ice, storm, flood, earthquake, subsidence, epidemic or other natural disaster;
(iv)    Disruption to or failure of the railways, shipping, aircraft, motor transport or other means of public or private transport;
(v)    Disruption to or failure of public or private telecommunications networks or utility supplies;
(vi)    Closure or limited access to Cineworld Cinemas on the grounds of Cineworld’s reasonable health and safety concerns;
(vii)    Any governmental act, decree, legislation, regulation or restriction.

15.3    Cineworld’s liability for faulty Unlimited Cards is limited to the remedies described in clause 9.

15.4    Cineworld’s liability for its breach of the Agreement is limited to the annual subscription fee.

15.5    Cineworld will not in any event be liable for: (a) any loss of profit, revenue, business, contract, goodwill, or other financial or economic loss or damage; or (b) any indirect loss or damage which is not reasonably foreseeable as likely to occur in the ordinary course of events.

15.6    Cineworld does not exclude or restrict its liability for fraud, for death or personal injury resulting from its negligence or that of its agents or for any other liability that it cannot restrict or exclude by law, and nothing in this clause 15 shall operate to exclude, restrict or limit this liability.

 

General

16.1    The Agreement and any disputes or claims arising out of or in connection with it (including non-contractual disputes or claims) are governed by the laws of England and Wales and are subject to the non-exclusive jurisdiction of the courts of England and Wales, unless You live in Scotland, Northern Ireland or Ireland in which case the relevant law will apply and You can choose to take action against Cineworld in your local courts. 

16.2    Cineworld does not accept amendments by You to the Conditions. Any variations to the Conditions must be signed by one of Cineworld’s authorised signatories.

16.3    You and the User may not transfer any of your rights or obligations under the Agreement to another person without Cineworld’s prior written consent. Cineworld can transfer all or any part of its rights or obligations under the Agreement to another organisation but your and the User’s rights under the Agreement will not be affected.

16.4    If the Agreement is terminated by either party for any reason, neither party will lose any rights which have already accrued.

16.5    If, at any time, Cineworld does not require You to comply with any part of the Agreement, this will not prevent it from doing so in the future.

16.6    If any part of the Agreement is disallowed or held to be ineffective by any court or other competent body, the rest of the Agreement will not be affected.

Terms and Conditions for the Unlimited card online ticket booking offer

18.1    The following terms apply to ticket bookings made through the Web Site using an Unlimited Card. 

18.2    Tickets booked online using an Unlimited Card may only be booked through a mycineworld account.    All online ticket bookings are subject to the Cineworld Website Terms of Use.  The Cineworld Online Ticket Purchases Terms will apply to bookings for tickets using an Unlimited Card as if payment for the ticket had been made using a debit, credit or charge card except as set out in this clause.  Use of the Unlimited Card will remain subject to the Unlimited Terms and Conditions.

18.3    Only one ticket per Unlimited Card may be booked online at any time and no further online ticket booking may be made using that Unlimited Card until the screening to which the existing booking relates has come to an end.

18.4    mycineworld discounts will not apply to (i) any uplift payment for tickets for 3-D screenings booked online using an Unlimited Card or (ii) tickets for alternative content screenings booked online using an Unlimited Card, although the usual Unlimited discounts for these types of screenings will continue to apply in accordance with clause 7.2 of the Unlimited Terms and Conditions.

18.5    Tickets for other customers may be booked for the same screening as part of the same transaction at standard prices for the relevant performance (less the mycineworld discount being offered at the time of booking(if any)). You may also include ticket bookings for the same screening for other Unlimited customers as part of your booking, but please ensure that you have obtained their permission in advance.

18.6    Payments for additional tickets and any surcharges must be paid for online using a valid debit/credit/charge card or Cineworld Gift Card or e-Gift Card (where available).

18.7    Pre-booked tickets can be collected at the relevant Cineworld cinema Box Office, Ticket and Concession Stand or automatic ticket machines (booking reference required for collection from ATM) on the day of screening with the exception of tickets for alternative content or Unlimited exclusive screenings which may be collected at any time after the date of booking. 

18.8    Tickets will only be issued on production of (i) the Unlimited Card used to make the booking, (ii) the relevant booking reference or (iii) where a payment has been made as part of the booking transaction, the debit/credit/charge card used to make the payment. E-ticketing is currently not available for tickets booked online using an Unlimited Card.   

18.9    Each Unlimited customer for whom a ticket has been booked must show their Unlimited Card when the tickets are checked before entering the relevant auditorium. 

18.10    Any ticket booked online using an Unlimited Card must be collected no later than 20 minutes before the advertised screening time on the day of performance otherwise Cineworld may release it for general sale.  No refunds will be given.    

18.11    Cineworld may (i) discontinue or change the online booking function at any time without notice and/or (ii) amend the terms and conditions of the Unlimited Card online booking offer from time to time without notice.

Terms of current Unlimited offers and discounts

19.1    Unlimited offers and discounts are only available on production of a valid Unlimited Card. 

19.2    IMAX, D-Box and Alternative Content uplifts are still payable.  3D uplifts are currently not payable by Premium Unlimited customers but will remain payable by all other Unlimited customers.  Charges apply for 3D glasses and VIP/Delux seating as they are not included as part of Unlimited membership. 

19.3 Discounts on food and drink available only when purchased in-cinema and do not apply to any items purchased online. Maximum discount of 10% on Starbucks products.
Discounts may not be available in conjunction with some offers and promotions.
